Given the media meltdown over finger-pointing meme-ified WNBA player Sophie Cunningham’s statement that girls sports should be for girls, here’s a brief timeline of the vanishingly few active professional female athletes who have spoken publicly in support of women’s sports for women, and responses that explain why there are vanishingly few active professional female athletes who speak publicly in support of women’s sports for women.

If, for example, you’re blanking on the name of the Canadian cyclist who protested males in women’s cycling by wearing a women’s-supportive t-shirt on the podium, your search will frustratingly come up with Kristin Worley, one of the Canadian male cyclists women were protesting about. Unless you type Danika Schroeter’s name into a search engine, the internet has erased any record of female athletes speaking out in support of women’s only sports. Way back in 2002, the Canadian Cycling Association gave male mountain biker Michelle Dumaresq (Cycling News in 2006 called Dumaresq a “transsexual”) a female race license. Five of the top women riders, who were very supportive of Dumaresq as a rider and a person, but felt it was unfair competition, suggested CCA create a new trans category. They were ignored. Dumaresq won the Canadian downhill national championships in 2006 for the third time. A friend handed Danika Schroeter a Sharpie-lettered t-shirt that read 100% Pure Woman Champ 2006, which she wore as the silver medalist on the podium, while her supporters “shouted obscenities” at Dumaresq. CCA suspended Schroeter for three months. Schroeter appealed that punishment, saying it did not align with UCI’s discipline policy. CCA said the discipline was warranted “because of the way she used the national championships podium ceremonies to air her views in an offensive manner, not because of the issue she chose to protest.” CCA went on primly that women could express their views that it was unfair for men to compete in their sport as long as they did so “in a moderate and respectful manner.” Let’s recall where five years of moderate and respectful expression of views got them. The “compromise” that CCA landed on was that Schroeter was to publicly apologize for her actions and apologize in person to other riders when she was allowed to participate as a member of the Canadian team at the mountain bike world championships. She could serve her three-month suspension after that. Her grovelling public apology was printed in Pedal Magazine, including this: “The message upon my t-shirt was inappropriate, insulting and directed negative attention towards my sport.” Schroeter was utterly humiliated. CCA, who knowingly allowed a man to compete in women’s sport, handing him awards and spots on national teams meant for women, was never disciplined for their egregious violation of the foundation of the sport. This appalling demonstration ensured no actively competing female cyclists stood up for their rights, “moderately” or otherwise, for more than a decade as males paraded in their sport with impunity. Even after UCI finally decided the women’s category should be for women (or males who messed with their endocrine system as children) in 2023, there was no public apology for destroying women’s sports for 21 years. Women were meant to be grateful.

In June 2023, then D1 hockey player Britta Curl posted on social media in support of fellow hockey player Jocelyne Lamoureux’s support of USA Powerlifting’s attempt to maintain the female category for females only. Curl posted a response to calls for Lamoureux to lose her job for “abhorrently transphobic behavior” saying: "Females protecting female players on the female players association board? Thank you LamoureuxTwins.”

The sky darkened, the curtains of Democratic headquarters were rent in two, and kind, loving trans allies the world over took to their keyboards to dump hot bubbling vitriol on Curl’s curls, calling her not only transphobic but, oddly, racist. The screeching got even louder and more poisonous when, in 2024, Curl was drafted by PWHL (the W is for Women’s; the transphobia never stops) Minnesota, to the point that, in order to salvage not only her career but her skin, she issued a grovelling Instagram apology for the “hurt” and harm she caused by supporting someone else for supporting women’s sports for women. This sent the Man Mob into a frenzy. Now, two years later, Curl-Salemme is still booed every time she steps on the ice. I have never seen anything like the spitting viciousness, open incitement to violence, the orders of magnitude out of proportion hate, in professional sports, men’s or women’s. This insanity was described recently in mainstream media as “significant criticism.”

In October 2025, Angel City defender Elizabeth Eddy wrote an op-ed in the New York Post calling for some kind of eligibility standards, since again, the NWSL (is that W just decorative?), the professional women’s soccer league, has no definition for what constitutes a woman. Eddy suggested players either “be born with ovaries” or the league institute genetic testing.

Again, the skies darkened at mid-day, birthing people shielded their children from the violence of those words, and her teammates and Angel City front office folx quick called a press conference so that they could call Eddy transphobic and (again, somehow) racist on TV, and announce to the world that women’s professional soccer did not care about women and was not a serious sport since it was more of an all-comers league who very much supported leading scorer Barbra Banda and other players who had been barred from playing in the 2022 Women’s Africa Cup of Nations because of “high testosterone levels.”

Eddy told NBC News that since her op-ed was published, she heard from current players "who agree with my points, but are too fearful to speak up.” She told OutKick she thought about speaking out for a long time but “selfishly” valued playing more than doing what she knew to be right. She knew that saying out loud that women’s sports should be for women would be career ending. This was 2025, folks. That changed when Angel City scrimmaged with a boys’ U14 team, and lost. The Angel City captain then decided to end scrimmages with teenage boys because of injury risk and the fear that the boys’ parents would video the practices and post them online, and “it wouldn’t look good for the team. To me, that was a huge wake-up call," Eddy told OutKick. "If professional athletes of the highest level were so physically outmatched by teenage boys, yet there's this pressure to hide that reality rather than acknowledge it. That's why protected categories are so vital." Five months after her op-ed was published, Eddy announced her retirement.

Cut to right now, that straight-talker out of the Show Me state, Sophie Cunningham, has made a meme out of pointing out wrong-doing. But what made the media lose their collective minds was, not an accusation, no pointing, no hate, just a simple statement of “common sense” and “love” for biological women in a long profile in ESPN. Though it was an extensive wide-ranging story including her family life, her resume on the paint, her style of play and reputation for standing up for, and pointing out, what’s right, the small part of the profile the media seized on was her statement that girls should be protected in the locker room and that “they shouldn’t have to go against biological men.”

She’s a woman playing in professional women’s sports: recognizing the importance of these foundational realities does not seem in any way controversial. Unless you interpret “I support women’s sports” as anti-trans. Which the media almost universally did. While she said girls and women should not have to compete against “biological men,” reporters and editors reflexively demonstrated reality—they mentally equated biological men with trans. Biological men = trans. Oops.

The New York Times headline read: “Sophie Cunningham says it’s ‘common sense’ to keep trans athletes out of women’s sports.” She said nothing of the kind. She said it was common sense to protect girls and have male-free sports. Her comments were about girls and women and supporting Title IX rights. She never said anything anti-trans. The paper of record misquoted her in the headline. The Hill’s headline read: “WNBA star defends efforts to ban trans athletes from youth sports.” Misrepresented again. Her focus was on protecting the rights of girls and women, not banning trans athletes. Yahoo Sports went further into propaganda territory, quoting one male sportscaster who opined that “the WNBA needs to suspend her,” and became hysterical because Cunningham “refused to apologize.” That tactic has worked before; why isn’t it working now? He lost his shit because a woman would not apologize for saying women’s sports should be for women.

OK, Fox News got it right: “Sophie Cunningham inspires young athletes to speak out on protecting girls’ sports.”

So, yes, in 2026 it’s still impossible to make a blindingly mundane straightforward women’s-sports-for-women statement without the media 1) interpreting that as anti-trans, and 2) endlessly reflecting their own rigid captured narrative back. The media played a key role in instituting gender ideology and spreading ideology as fact, and they are desperately beating that dead horse, even as the public and sports organizations back away.

Here’s where Cunningham’s story veers from Curl’s and Eddy’s. Throughout this media-orchestrated struggle session, John Q. Public has quietly nodded along with her. The majority of commenters to The New York Times coverage wrote something along the lines of, She’s right you know. The vast majority of Americans think women’s sports should be for women, and critically, they now know they are in the majority.

No enforcers from the WNBA or the Indiana Fever have come to make Sophie Cunningham an offer she can’t refuse. No press conference has been called to denounce her. On the contrary, the Fever announced they support her freedom of speech, and let her loose in the mixed zone. They’re reading the room: A pro female athlete saying …

“If Title IX and women’s sports weren’t protected, then you wouldn’t hear about any type of women in sport. And so, I think in the future, it’s just really important to protect.”

is resonating with people. Turns out, women saying women’s sports should be for women is good for the WNBA. Who knew?

Far from being dropped by sponsors, ESPN pointed out that, for a reserve player, Cunningham has the kind of top-tier, star power recognition and relatability that makes sponsors’ hearts go ka-ching. Her own Adidas Crazy Energy PE kicks came out July 24th.

Coming on the heels of Women’s Tennis Association’s announcement that they will protect the integrity of women’s tennis with genetic screening, and the Supreme Court’s ruling that states may organize sports by sex, quite suddenly the fever has broken. People are realizing, not only should women’s sports be for women, but that it’s not in any way controversial to say women’s sports should be for women. What Sophie Cunningham’s finger has exposed is the media’s role in silencing women, shaming female athletes, gaslighting the public, and now desperately trying to keep the lie going. Cunningham has proven, women can say out loud that women’s sports should be for women and not be smote with the vengeful fires of transrighteousness. That meme-ified finger pointed unapologetically at women’s rights.

My letter to the Minnesota Star Tribune about Governor Walz’s third-grade response to the Supreme Court decision was printed. It follows. Please read the many comments (it’s such a fringe thing, why would anyone care?). The very first comment demonstrates what I was talking about—he called me names instead of engaging with the topic—why should girls give up their single -sex rights to boys? No one answered that.

The Supreme Court recently ruled that states may organize sports on the basis of sex. As part of that ruling, the justices agreed that Title IX allows for sex-separated sports, and that sex means biological sex, not gender identity.

As a result of this ruling, the 27 states that already organize school sports by sex may continue to do so. The 23 states that organize sports according to a student’s gender identity, including Minnesota, may continue to do so.

The decision was rational and objective, supported by scientific evidence. By comparison, Gov. Tim Walz’s response was off-key, hyperbolic … weird. He said: “As the Supreme Court says states can be cruel to trans kids, my message is clear: Here in Minnesota, we stand with and value our trans neighbors and youth.”

The Supreme Court did not say states could be cruel to trans kids. It said nothing of the kind. That’s not an interpretation; that’s an outright lie. Why would Walz characterize the very reasonable upholding of federally enshrined women and girls’ rights as “cruel”?

He provided no rational argument for continuing to violate girls’ and women’s Title IX rights but rather impugned the ethics of those who support them. He says it’s not just wrong — you’re a bad person for believing in science, in reality, for supporting girls’ sex-based rights. You’re cruel. It shuts down reasoned discussion of who is eligible for girls sports and shifts it to the morality of the other party. This is emotional, manipulative language, the realm of someone who has no rational argument. You’re either cruel or you “stand with and value our trans neighbors and youth.” Which necessitates erasing women and girls’ right to single-sex sports.

No need for emotional accusations; that’s straight up against federal law. Walz employed emotional manipulation straight from the abuser’s handbook to deflect from the fact that he has no excuse for continuing to violate the rights of half of Minnesota’s population.

Here are the comments:

Do the right thing and let grade school and high school trans athletes play on the team that they want.

But on college or pro events they must play on the biological they were assigned.

What’s the difference? Does something magically change when someone graduates high school? So as example, a kid excels in high school, gains a scholarship and then they can’t use it? Or gets drafted by a pro team and they can’t play?

Love the term “assigned”. As if some medical team is evaluating some collection of data and somehow reaching a conclusion.

The difference is fairness of competition between males and females of some sports.

A) Fairness how?...regarding what, exactly? -which then raises...

B) How are the groups “male” and “female” to be defined?...gametes?...chromosomes?...a particular phenotype? -none of those methods will result in two, neat groups- and what evidence is there to support the efficacy of the sorting method in achieving the stated goal of “fairness”?

gweirda...To ensure absolute fairness, perhaps the association with sex/gender should be eliminated, have one team and let the best athlete(s) perform. In basketball, no NBA/WNBA; for hockey, no NHL/PWHA; in tennis one class but allow mixed doubles, etc.

Using let the best person excel appears to be the best course of fairness to eliminate the issue(s) you appear to be concerned.

One team would mean the end of girls sports. What 5 girls could match 5 boys in 10th grade basketball?

This particular topic has been written about, debated, commented on, accepted and ridiculed. I’m not going to rehash those arguments here.

I’d love to do the same - but since the status quo sees a vulnerable minority being harmed, I’m not comfortable walking away from a debate with those who hold the floor by simply shouting/chanting the same ignorant nonsense over and over.

I’ve always loved the term “fairness” when it comes to sports. For ex. -is it fair that some kids are born into a family where the parents can afford a one to one coach in the sport of their choice? Buy all the best equipment? Is it fair that I was a 5’ 7” slow kid who weighed 145 pounds on the HS football team? Or one of my favorites from long ago & I forget some details so excuse by condensed version. A woman was an African country was not allowed to participate in the Olympics because her testosterone levels were to high (no drugs). She was told it “wouldn’t be fair.” Her response was, well I’m competing against runners from other countries who have shoe contracts (she ran barefoot), nutritionists, individual coaches, stipends for training, and other advantages. What’s fair about that?

A professional competition should require you play on the team of your biological birth. We are talking about Olympic medals or professional sports with money involved.

Should be at the highschool level as well. Why should girls give up their spots on teams, why should girls face a male pitcher (as they did last year when the state high school girls softball championship team had a male (who identifies as a girl) as their pitcher). Why should one male on a girls soccer team allow them to dominate over other teams (and bench an otherwise eligible girl). This is unfair at all levels.

Women’s and Girl’s sports are just that.... for Women and Girls! Sad people are wanting to reverse decades of equal opportunity for Female athletes!

No one who voted for an adjudicated sexual assaulter and does not support women’s right to choose when or whether she gives birth has any business chiming in about women’s rights.

Make all sports unisex. Let the person’s ability sort out what level they compete at.

In other words, very few girls will be in sports like track and field, hockey, volleyball, basketball, swimming, lacrosse, baseball and any other sport where boys typically are better athletically. There’s a reason why title IX was implemented…and rightly so.

Well you either have sports grouped by biological sex or remove the groupings...a vocal minority seem to be proponents of removing the biological sex groupings for sports teams.

That’s because a VERY vocal majority want to continue with simplistic groupings that:

a) are ill-defined (at best), and

b) do not advance the purported goal of grouping (but rather: hide the true goal of control/power)

The biological sex groupings are based on physical differences between males and females. The goal of the biological sex groupings is to create more fairness in competition.

The biological sexes are very well defined. Why do say they are “ill-defined (at best)”?

Certain traits/phenotypes may be well defined (though still producing a binodal rather than binary distribution?), but they don’t carry across to people on a consistent basis - at least not well enough to justify being cruel to an already-vulnerable minority of children, especially when the goal of such groupings is the maintenance of a harmful status quo often defined by vague, handwaving references to ‘fairness’.

Are you suggesting that the human species does not have a demonstrated binary biological sex difference, in which the vast majority of humans are either XY or XX, with small or large gametes?

I’m not asking whether there are humans who are exceptions to this binary biological sex difference.

I’m asking whether you are suggesting that there is no demonstrated binary biological sex difference (such as XY or XX) in humans.

This essay was originally published on Forward Nebraska. This version contains a few more details that led to the author’s involvement in the issue of males competing in the female category.

On June 30, 2026, the U.S. Supreme Court issued one of the most significant decisions in the history of women’s sports. In a joint decision for the cases of West Virginia v BPJ and Little v Hecox the Court held that states may constitutionally limit participation in girls’ and women’s sports to athletes who are biologically female. Importantly, however, the decision does not require states to do so. Today, 27 states have enacted laws protecting female sports, while 23 have not.

Contrary to much of the public rhetoric surrounding these laws, the decision does not prohibit anyone from participating in sports. It does not ban transgender athletes from competition. Rather, it recognizes that states may require athletes to compete in the category corresponding to their biological sex. Like age divisions and weight classes, sex based athletic categories exist because they promote fair and safe competition.

For me, this Supreme Court decision is also deeply personal.

My involvement began in 2019, not in a courtroom, but in my classroom at the University of Nebraska at Kearney. After CeCé Telfer won the NCAA Division II women’s 400 meter hurdles national championship, several of my exercise physiology students asked a straightforward question: Does male biology still matter in athletic performance after a male undergoes transgender hormonal interventions?

Before CeCé Telfer won the NCAA Division II women’s 400 meter hurdles championship and my students began asking questions about males competing in women’s sports, I was certainly uncomfortable with the NCAA and International Olympic Committee policies allowing males into the female category. But I also assumed I must be missing something. I thought perhaps there was important research on testosterone suppression that I had not seen, or that the NCAA and IOC had access to evidence that had not yet been published. In other words, I trusted that the experts knew something I did not, or that if these policies were scientifically indefensible, prominent exercise physiologists would be speaking out. Besides, I was just a professor at a regional public university in central Nebraska. What difference could I possibly make?

As an exercise physiologist, I realized I could answer that question scientifically. As I began examining the scientific literature more carefully, I realized I was not overlooking some hidden body of evidence. Biological sex influences athletic performance in ways that extend far beyond circulating testosterone. Instead, I found that remarkably few scholars were willing to publicly question, let alone oppose, the prevailing narrative supporting the inclusion of biological males who identify as girls or women in the female sports category, despite the growing body of physiological evidence raising questions about those policies.

Around that same time, I saw news coverage of Selina Soule and her lawsuit challenging the policy of the Connecticut Interscholastic Athletic Conference that allowed males to compete in girls’ sports. The plaintiffs were being represented by Alliance Defending Freedom (ADF). The timing seemed almost providential. I contacted Alliance Defending Freedom and asked whether they needed an exercise physiologist. I had no idea where that email would lead, but it turned out to be the beginning of a journey that eventually reached the United States Supreme Court. Once I became involved, I felt a responsibility to continue speaking wherever I believed my scientific expertise could be helpful.

That decision ultimately led me to serve as an expert witness in several legal cases. Since 2020, I have prepared expert reports in Hecox v. Little, BPJ v. West Virginia, and other lawsuits involving women’s sports. Along the way, I have testified before legislative committees in multiple states and published numerous scholarly papers examining the role of biological sex in athletic performance and women’s sports.

My wife supported my decision from the beginning. She believed, as I did, that standing up for scientific truth was worthwhile. Neither of us, however, anticipated how much this issue would come to shape my professional life over the next several years. At the time, very few exercise physiologists, or scientists in closely related disciplines, were willing to publicly state what decades of exercise physiology research had consistently demonstrated.

The academic environment made doing so professionally risky. Diversity, Equity, and Inclusion initiatives had become deeply embedded throughout higher education, and publicly challenging prevailing views on transgender participation in sports carried the potential for significant personal and professional consequences. The attorneys I worked with from ADF, along with attorneys representing the states of Idaho and West Virginia, warned me to expect criticism online, in person, and possibly within my own profession.

I do not recount this to portray myself as courageous or heroic. Rather, it was simply a point in my career when I had to decide whether remaining silent was compatible with my responsibilities as a scientist and educator. I concluded that scientific evidence had to take precedence over political correctness. Looking back now, I remain convinced that it was the right decision.

The scientific principles underlying my testimony were and remain straightforward.

First, males and females differ biologically in numerous ways that directly influence athletic performance. Those differences extend far beyond testosterone and include anatomy, muscle mass, strength, power production, aerobic capacity, hemoglobin concentration, tendon properties, skeletal structure, and many other physiological characteristics.

Second, these biological differences produce meaningful athletic advantages for males when compared with equally aged, equally trained, and equally talented females. Importantly, these advantages are not limited to adults. My own research, along with the work of many other investigators, has demonstrated that measurable performance differences exist even before puberty in running, jumping, throwing, swimming, strength, and other athletic tasks.

Third, the available scientific evidence does not support the claim that puberty blockers, testosterone suppression, or opposite sex hormones eliminate male athletic advantages. These interventions alter some physiological characteristics, but they do not reverse male development or erase the cumulative advantages associated with male physiology. That conclusion has become increasingly well supported as additional studies have been published during the past several years.

When I submitted my first expert reports, these conclusions were often portrayed as controversial. In reality, they reflected well established principles of exercise physiology.

What was unusual was not the science itself, but the reluctance of many scientists to discuss it publicly in such a politically charged environment.

The scientific landscape has changed considerably since then.

Today, organizations including World Athletics, World Boxing, and the International Olympic Committee have all adopted policies recognizing that biological sex remains relevant to fairness in sport. Although their policies differ in important respects, they increasingly acknowledge that lowering testosterone alone does not eliminate male athletic advantages.

The discussion has gradually shifted away from ideology and toward physiology.

Has my involvement in these cases affected me personally or professionally? That is impossible to answer with certainty.

What I can say is that many colleagues have privately told me they agreed with my scientific conclusions but were unwilling to express those views publicly because they feared the professional consequences. I have also had colleagues advise me that I would be better off if I were less outspoken on this issue. Those conversations were often more revealing than any public debate.

I have also encountered resistance during the publication process. On one occasion, a manuscript was rejected because of using the single word “transwomen,” which one reviewer described as a “politically charged right wing dog whistle.” According to the reviewer, the two word phrase “trans women would have been acceptable. In academia, scholarly publications are one of the primary measures of professional success, so editorial decisions like this matter.

I cannot say that I have ever been denied a promotion, position, or professional opportunity because of my work in this area, nor would I attribute every professional disappointment to this issue. However, I have had individuals outside academia tell me they intended to have me fired because of my publicly stated views. Whether any of these experiences ultimately affected my career is impossible to know. The pressure itself, however, was real.

Looking back, I have no regrets about participating in these cases. Scientists should not tailor their conclusions to fit prevailing political fashions. Richard Feynman famously warned that “the first principle is that you must not fool yourself.” Our responsibility is to evaluate the evidence honestly, report it accurately, and follow it wherever it leads.

The Supreme Court’s decision does not resolve every question surrounding transgender participation in sports. Those discussions will undoubtedly continue. What the decision does establish is an important legal principle. States may recognize the biological differences between males and females when creating athletic categories intended to provide fair opportunities for girls and women.

Women’s sports were created because biological sex matters in athletic performance. If males and females performed equally, there would never have been a need for separate athletic categories in the first place.

For decades, society has recognized that reality in virtually every organized sport. The Supreme Court’s decision affirms that states may continue to do so. As someone who has spent a career teaching exercise physiology and several years reviewing the scientific literature for these legal cases, I find that conclusion encouraging, not because it advances one political viewpoint over another, but because it recognizes a principle that lies at the heart of both science and sport: fairness depends upon acknowledging biological reality.

When I first answered my students’ questions in 2019, I never imagined they would lead me to become involved in litigation that would eventually reach the United States Supreme Court. Yet that is exactly what happened. It is a reminder that important national debates often begin with ordinary conversations in classrooms, communities, and homes, and that scientific expertise developed here in Central Nebraska can have an impact far beyond our state.

Drowning in the media firehose that followed the Supreme Court decision to allow states to organize sports by sex, I found it clarifying to step away from the relentless spittle spray and take some time to read the actual document. It’s not byte-sized but it is worth the time: I encourage you to read it and draw your own conclusions. Because as you guessed, mine are coming up.

I was reminded, from the first paragraph of Kavanaugh’s majority opinion to the last of Jackson’s dissent, of World Rugby science and research consultant Ross Tucker’s experience in crafting that organization’s policy for eligibility for women’s teams. He and other advisors set up a panel of experts representing both sides of the issue—those who supported the inclusion of men who identified as women and those who supported a female-only category. Each side had the opportunity to present their arguments to the committee, like in a court of law, so the committee could weigh the evidence side-by-side and make an informed decision. Tucker recounted that by the morning coffee break on the first day of “testimony,” committee members who had previously been either uninformed or undecided commented that they could not believe the difference in the strength of the arguments. It was startling, they said: One side used scientific evidence and rationality; the other side relied only on emotion. Committee members hadn’t realized until they listened to the arguments in juxtaposition that the “debate” was not a debate at all. They had no problem deciding that the women’s category should be restricted to natal females.

It’s important to know that “listening to the experts on both sides” was, purposely, not employed when state high school sports associations, the NCAA, the IOC, and nearly all sports organizations first allowed males in female sports more than a decade ago. On the contrary, when faced with creating a “transgender policy,” these organizations wrongly identified athletes with trans identities as the only stakeholders, so they typically consulted only trans rights activists and athletes with trans identities, with predictable results.

I too was shocked by the difference in the strength of the arguments, between the majority opinions, written by Kavanaugh, Thomas, and Gorsuch, and the dissenting opinions written by Sotomayor and Jackson. One side used accurate language, scientific evidence, and rationality to consider the rights of girls and boys with trans identities. The other side focused solely on the feelings of male litigants, made ideological claims with no evidence, and relied on emotion and absurd straw man arguments. Sotomayor et al’s arguments boiled down to BJP is a special boy/girl because he says so (and so does his mother), and he should be allowed to participate in girls’ sports because he wants to. That’s it. Nothing more.

The dissenting opinions lacked, not just evidence and mature reason, but a firm grasp on reality. It was hard to believe their’s was an issuance of the highest court in our country, and not a transcript from Wind in the Willows Elementary School’s debate club. Having waded through the whole document, having digested both sides, my overwhelming takeaway is that I can’t believe there is any debate on this at all. It’s that one-sided. I support this conclusion with excerpts from the original document.

Kavanaugh started out by talking about the purpose of Title IX:

To provide equal opportunity for female athletes, schools do not merely maintain, for example, one soccer team, one basketball team, one ice hockey team, and one lacrosse team that are equally open to female and male athletes. That approach would deny equal opportunity to female athletes because, as all agree, females and males have inherent physical differences relevant to athletic performance.

Right away, he identified the stakeholders in this discussion as girls, and that well documented sex differences were the reason schools maintained separate male and female sports teams. Throughout his opinion, he used accurate language, referring to BPJ and Lindsay Hecox as “biological males who identify as female.” This made the opinion easy to read, understandable, and frankly, believable. As if it came from an informed objective source.

May schools determine eligibility for women’s and girls’ sports based on biological sex? The answer is yes.

Kavanaugh credits single-sex sports with empowering millions of American women to thrive in all aspects of life. In sharp contrast to almost all discussion of males in female sports in all major media but in alignment with the views of the vast majority of Americans, opportunity and access to sports for women and girls is the focus of his opinion.

Kavanaugh referenced the extensive research that led the NCAA and the IOC to restrict women’s sports to females only, pointing to the research that shows that tinkering with hormones does not eliminate male advantage. He calls BPJ and Hecox “biological males who identifies as female,” and pointed out that though BPJ had taken puberty blocker and cross-sex hormones, he won the West Virginia state title in shot put, finished fourth in the state discus competition, and had won both events at the region level.

BPJ argued that, while it was fine for WV schools to organize male and female teams, since he had headed off male puberty with drugs, he, as a biological male (Kavanaugh never accedes that BPJ IS female) who never went through male puberty, has no advantage in sports, and should he be given an exception to participate in girls’ sports. BPJ argued that he is, not a female, but a special male who, because he has altered his hormonal profile, should be allowed to participate in female-only sports. Because Hecox went through male puberty and could make no special male claims, he is rarely spoken of in either the majority or the dissenting opinions. Kavanaugh wrote:

As B. P. J. sees things, if the regulations authorize a school to limit women’s and girls’ sports teams to biological females, then the regulations are not “reasonable” and therefore are unlawful. We disagree.

For once—and this is beautiful—Kavanaugh directly addressed both the absurdity of boys (and their parents) who have chosen to make themselves weaker by taking powerful hormones and then claim this choice makes it impossible for them to compete successfully on boys’ teams, AND exposes his core argument for competing on the girls’ teams—because I want to—with this searing statement (emphasis is mine):

B. P. J. has taken puberty blockers and hormones, meaning that B. P. J. apparently will no longer be strong or fast enough to compete successfully against boys. Moreover, B. P. J. might not want to compete against boys. Either way, it is an unhappy occasion whenever a student who wants to play school sports cannot do so. We appreciate the desire of every student, including B. P. J., who wants to play school sports. And we recognize that student-athletes are understandably disappointed and upset when they do not make a team or otherwise cannot participate. But the Title IX regulations guarantee “equal athletic opportunity.” The regulations cannot and do not guarantee every student a spot on a team’s roster.

This is what Myron Genel should have told the two men who had cut off their parts and demanded to compete in women’s Olympic cycling in 2002 or so. This is what EVERY male who has ever demanded to compete in women’s sports should have been told. You made choices. You’re still a man. Them’s the breaks. Man. Kavanaugh acknowledges not only that BPJ’s demand is just that—a demand—but that it’s an “unhappy occasion” when the demander doesn’t get what he wants. Yes, BPJ will be sad. He might not want to compete on the boys’ team, and he may have made himself not competitive with drugs. But that’s not a reason to violate all girls’ rights. Wow. The simplicity, the clarity, the rightness, the adultnesx of this statement—sort of depressing that it took decades and a Supreme Court ruling to hear it.

Directly addressing Sotomayor’s and, by default, every single emotional plea to think of the poor boys that has dominated this discussion, Kavanaugh wrote:

we do not accept the dissent’s [Sotomayor’s] assumed monopoly on understanding the effects on individuals involved in disputes over transgender athletes. We are acutely aware of the difficulties sometimes faced by boys who identify as girls (and by girls who identify as boys) in middle school, high school, and beyond. And we greatly admire the desire of all students, including transgender students such as B. P. J., who want to participate in sports. But in conducting the equal protection inquiry, we must also account for the effects on girls who are forced to compete against biological males in sports.

“Assumed monopoly on understanding.” Burn. Once again, he acknowledges the sad boys but redirects to the real stakeholders—girls. And if you want to talk about feelings—fine. He talks about girls’ feelings of hard work, competitive spirit, team bonding, sense of accomplishment, and how those feelings are crushed when “girls are forced to compete with biological boys.”

Clarence Thomas, not known for his feminism, nonetheless did some beautiful plain speaking about manipulation of language in his concurrence. Citing several scientific papers, he wrote:

Men and boys with gender dysphoria are not women or girls, even if they believe that they are….To use language to obscure reality—to show “indifference regarding the truth”— is to lie to the public and cease to treat our fellow citizens “as equal[s].”

Gorsuch, in his concurrence, eviscerated Sotomayor’s word salad attempts at twisting the Bostock case into banning males from female sports is discriminatory. He wrote:

Put simply, it is a mistake to assume that, just because firing someone in part because of his biological sex amounts to unlawful discrimination in violation of Title VII, sponsoring a single-sex sports team limited to biological women or girls must also amount to unlawful discrimination in violation of Title IX. It’s a point Bostock took care to underscore.

And that’s where adult reason, logic you’d expect from the Supreme Court, ends. And the fourth-grade debate club starts.

Sotomayor’s opinion starts off using the ideological language Thomas said “obscures reality” and “lies to the public.” Her first sentence is:

Respondent B. P. J. is a transgender girl who wants to live her life consistent with her gender identity.

Describing BPJ as a “transgender girl,” Sotomayor does indeed obscure reality and lie to the public. She presented no evidence that BJP has “transitioned” or is a “girl.” She used a slogan as fact. She goes on to claim that because BPJ has altered his hormones, he has no male advantage:

…never experienced an endogenous male puberty, who receive gender-affirming treatment, and who, as a result of both, B. P. J. says, lack any athletic advantage that is inherent to their sex identified at birth.

The authority for this bold statement? The litigant says so. Give your head a shake, wipe your face Three Stooges-style, and try to remember this is written by a Supreme Court justice. Nevermind that Greg Brown, James Nuzzo, and about 65 years of school fitness tests have proven that measurable male advantage exists before puberty. Sotomayor could easily have availed herself of this data, but chose instead to just ask BPJ if he had any advantage. Yikes.

Sotomayor furthers her elementary school opinion by claiming the mean majority just “favor cisgender” girls and women, and “disfavor” transgender girls. They like girls, and they don’t like trans girls, so that’s why they upheld Title IX. Trans girls are, like, not even their fifth best friend. Read and wonder:

the majority extends great sympathy to those it favors: the young cisgender girls and women who play sports…Because the majority, however, inflicts a hardship on those it disfavors without giving them the fair and full opportunity the Constitution requires to litigate their contentions, I respectfully dissent.

Sotomayor accuses dumb mean people of defining biological sex as “an individual’s physical form as a male or female based solely on the individual’s reproductive biology and genetics at birth.” Which seems pretty correct. She doesn’t give a smart nice person definition of biological sex though.

In describing what a happy normal child BPJ is, Sotomayor wrote:

she began taking a form of estrogen to facilitate a typical female hormonal puberty.

Except that’s a great big lie. Starting with taking exogenous estrogen, there is no part of BPJ’s experience that was “typical” or “female.” And remember, this messing with cross-sex hormones is the heart of Sotomayor’s argument, that BPJ never went through male puberty, thus has no advantage and is a “girl.” You’d think she might have tried to bolster this key point with even some pseudoscience, but nope.

Sotomayor’s expert source to explain why BPJ shouldn’t have to compete with the boys’ track and field team was…wait for it…BPJ’s mother!

She did so because it would be inconsistent with her gender identity to play sports with boys. In fact, doing the latter would be quite harmful to her: Among other things, as her mother explains, it would “further isolate, stigmatize, and erase her.”

I guess neither BPJ’s mother nor Sotomayor read the 2025 Washington Post story about male high school student Eliza Munshi who identified as a girl. Munshi started in the spring on the girls track team in Falls Church, Virginia, but early in the season, Virginia restored their policy of single-sex sports. Munshi then joined the boys’ track team, and told the Washington Post, “everyone at her school has continued to make her feel welcome. ‘Sometimes I forget I’m transgender. People around me forget too.’ Munshi’s identity was unharmed. He was unharmed. He had friends of both sexes on the team, and enjoyed the camaraderie, sense of belonging, and pride in accomplishments that sports are known to provide. Munshi was not “isolated, stigmatized, or erased.”

BPJ’s mother was simply conjecturing this egregious harm would happen if her son was forced to participate on the boys’ track team, since her son had never participated on any boys’ team. She was making it up. Why? Why did she and her son assume such hateful behavior from boys? Why were they so bigoted toward other boys? Had they ever met any boys? Why were they male-phobic?

Even if Sotomayor had not read about Eliza Munshi, she surely must have been aware of Olympians Nikki Hiltz (US track star) and Swedish skier Elis Lundholm, both females who identify as not-female (I can’t say for sure what Hiltz’s identity really is; that’s only for her to know) but who have always competed in women’s sports. Observers, me among them, have wondered out loud why these two outstanding female athletes have not suffered the erasure, the dehumanization, the spontaneous combustion that BPJ’s mother, and apparently Sotomayor, insist will happen if kids with cross-sex identities compete in their sex category. Several decades of lack of evidence of harm supports my assessment that Sotomayor, a Supreme Court Justice, I have to remind you, put forward bullshit as her argument. Because it’s handy and well-used, and sounds better than saying BPJ was suing the state of West Virginia because he just wants to play on the girls’ team. Because he wants to. That’s the argument.

Not only pretty weak, but quite short. As a Supreme Court Justice, Sotomayor knew she had to fluff up her two killer points—he’s a girl because he says so (and so does his mother) and he should be in girls’ sports because he wants to (his mother says so too). So she kept repeating that BPJ is a dear sweet girl who has no advantage and is no threat to girls. It would have been stronger, or might have brought this opinion up to a fourth-grade level, if she’d presented evidence for any of these claims. But she didn’t.

The solid B student at East Buttwhistle Elementary/Supreme Court lifer spent many excruciating paragraphs giving examples of when the legal system did or did not create exceptions to a rule in an attempt to hammer home a thoroughly debunked notion—that messing with a boy’s endocrine system when he’s real young renders him weak enough to compete fairly in girls’ sports. THE ONLY scientific evidence—and there’s a lot of it—points to just the opposite. From age four (subjects younger than four have trouble following test instructions, and may need a nap), boys are bigger, stronger, faster, have greater endurance, and can throw farther and more accurately than girls. BEFORE PUBERTY.

Another reason Sotomayor could not support that hormonally-effed-up-thus-eligible claim is that it’s unethical to purposely introduce disease into a healthy child by injecting him with powerful harmful drugs, so such a study has never passed an Institutional Review Board which monitors safety and ethics of human studies.

A rule of science that Sotomayor seems ignorant of is that bold claims require equally bold evidence. It’s a pretty damn bold claim that a boy, inflicted with female hormones, “becomes” a girl, despite the myriad physical features unaffected by such an assault, including every XY cell in his body that have made him male since conception. And the fact that no humans have ever changed sex. So the evidence should be pretty damn strong that he’s a girl and and has no advantage. Yeah right. Nuthin. Sotomayor, a Supreme Court Justice, had and has NO ARGUMENT other than that the litigant says he is a special boy and has no advantage.

After pages of word salad, Sotomayor concluded with this:

The facts here illustrate the difference. B. P. J. was told that she cannot play on girls’ teams because she was identified as male at birth. If her sex identified at birth had been female, however, B. P. J. would have been allowed to play on girls’ teams.

Uhhmm, yes. Those are the facts. Sotomayor went on about facts, which was a dangerous new line of attack for her:

Because of the Court’s decision today, West Virginia, and any other state actor, can deny B. P. J. and others like her these experiences simply because it thinks they have an inherent athletic advantage, even if the facts show that they do not.

Uhhmm. She did not show any evidence that either BPJ, Hecox, or “others like her” did not have advantage. See, saying something does not make it a fact. BPJ saying she did not have an advantage does not make it a fact.

Astounding but true, that’s her parting shot. That’s all she got. She didn’t talk about Lindsay Hecox at all because Hecox never jiggered with his hormones as a child, so is by Sotomayor’s assessment, just a male demanding to participate in women’s sports. She argued BPJ is a special boy/girl because he says so, and he should be in girls’ sports because he wants to be. Wow. Okay.

The non-biologist who could not say what a woman is, Justice Jackson, nonetheless waded in way over her head with this:

But there is reason to doubt the soundness of the concession that Title IX’s reference to “sex” means only sex assigned at birth.

She was stupid enough to bring up stereotypes and “transgender women” in the same sentence and then burped up as her parting shot this fantastic fabrication about Title IX:

Title IX makes room for individuals to live in the gender they choose; it cares not just about sex assigned at birth but also about individuals’ ability to match (or not) their gender presentation to their gender identity. Because West Virginia’s law forces B. P. J. to live—in this case, to play—as a boy though she is a girl, it might well run afoul of Title IX properly construed.

That is an absolute lie. Title IX, “on the basis of sex” does not hint at gender, does not give a flying fuck about gender, is not tainted by gender. West Virginia law, and Title IX recognizes sex. Jackson presents zero evidence that Title IX “makes room for individuals to live in the gender they choose,” and gallops straight from that idiotic statement to calling BPJ a girl. Because? Why? How? She beclowns herself and the vaunted position she holds.

There is simply no debate here. The evidence provided, all on one side, shows that boys are not girls, men are not women,but some boys want to participate in women’s sports and will be sad if they cannot. That’s all. It’s embarrassing that this case was entertained by the Supreme Court.

Justice Kavanagh, writing the Supreme Court’s decision in West Virginia v. B.P.J., breaks that norm—repeatedly, I might add. He does so not to “pound the law” or “pound the facts,” as the old adage goes, but to pound common sense, perhaps back into our country’s social psyche.

Kavanagh thrice describes sports as “zero sum.” Only once does he explain that term with reference to the outcome of a sporting event (maybe he knew the decision would be released during the World Cup, so wanted to leave breathing room for draws). In all three instances, he talks about the effect that one male would have on any one—and therefore, all—of the girls or women on a female team.

“Allowing a biological male athlete to compete on a girls’ team necessarily displaces or disadvantages a female athlete—replacing her on the roster, knocking her out of the starting lineup, reducing her playing time, depriving her of a medal, and the like.”

One more time, with feeling…

“Every biological male who makes the team takes a roster spot from a female athlete. Every biological male who earns playing time reduces the playing time of a female athlete. Every biological male who starts takes a starting position from a female athlete. Every biological male who wins a race takes the gold medal away from a female athlete.”

And for the dissenters in the back…

“Every athlete who makes a team takes a roster spot from another athlete. Every player who earns playing time reduces the playing time of a teammate. Every player who makes the starting lineup sidelines another who remains on the bench. Every competitor who wins a race or competition deprives another athlete of that victory, or medal, or prize. Every team that wins because of an added player means that another team has lost because of that added player. Every player who makes all-conference beats out another player who does not. Every student who earns an athletic scholarship takes that opportunity away from another student.”

I’m not saying he read my “blast radius” article, but he might as well have. And furthering the point, last month, while the case was pending, plaintiff Beckie Pepper-Jackson competed in two events at the West Virginia state track meet. He placed third in discus, knocking one girl off the podium and all but two others down a spot (along with their teams, which lost those points).

Kavanagh also pounds home the irreducibility and immutability of sex categories.

Justice Sotomayor’s dissent to the Equal Protection Clause argument attempts to dismiss the “zero sum” argument, before reluctantly agreeing that, well, yeah, it’s a thing.

Sotomayor notes that the plaintiff B.P.J. was trying out for a middle school cross country that, like many others, did not cut any prospective athletes. The roster, and therefore the opportunities, were not “zero sum” because nobody would be left out.

But as Justice Kavanagh points out in the first two quotes above, and then responded to his colleague’s dissent in the third quote, participation is only one aspect of what makes sport zero sum. B.P.J. may not displace any girls from the team’s roster, but he would displace girls at the team’s first meet. His presence on the team might also deter other girls from trying out for or competing on the team, or similarly deter or discourage opponents. Kavanagh addresses that, too, calling it a “second-order effect.”

Justice Sotomayor concludes her dissent by writing “Sports, of course, are often zero sum, but the law need not and should not be.”

However, Justice Kavanagh goes to great lengths to show why—particularly and maybe uniquely in sports—the law must be.

“Sports are different from, say, a typical employment or educational opportunity where equal protection often may require that the government generally treat an individual without regard to the individual’s sex.”

Early in the decision, Kavanagh references the “enduring” “[p]hysical differences between men and women… [which] include, among other things, height, weight, strength, speed, endurance, and jumping ability.”

He comes back to this several times, most importantly when he addresses the plaintiff’s “as applied” challenge to the equal protection elements. Kavanagh explains this as their concession that the “sex-based classification is generally permissible—but not as applied to those biological males such as B. P. J. and Hecox who identify as female and have taken puberty blockers or hormones.”

Kavanagh recognizes that there are neither guiding nor limiting principles for granting such exceptions. As such, there is no coherent and consistent basis in sport, physiology, or law for anything other than sex-defined categories.

“Individuals come in all shapes and sizes, with different height, weight, muscle mass, heart capacity, lung capacity, strength, speed, endurance, jumping ability, and so on.”

Any attempt at drawing a non-sex-defined line becomes an “almost impossible task” when you try to account for the “effects of the puberty blockers and hormones taken by transgender athletes—and then comparing each of those transgender athletes’ abilities to those of other individual biological males and individual biological females in the relevant sport.”

I’m also not saying he read my “sexclusive” categories article, but he might as well have done that, too.

“We need not belabor the point,” Justice Kavanagh writes. But he knows that we have to: otherwise he wouldn’t be writing a Supreme Court decision on this question.

Perhaps my biggest quibble with the Court’s ruling is when they address the plaintiff’s premise “that at least some biological males who identify as female and take puberty blockers or hormones do not retain physical advantages over biological females.” This, according to the Court, “is the subject of ongoing medical and scientific debate and is not settled in their direction at this time.”

That’s probably an act of collegial generosity, extending a hand to those justices who might have been unhappy about the fact that they couldn’t find a way around the Title IX arguments, and therefore ruled 9–0 on those and consoled themselves with the opportunity to dissent on equal protection grounds.

But that statement gives too much credibility to that ongoing “debate.” And while recognizing in beautiful understatement that the issue “is not settled in their direction,” it unnecessarily leaves open the door to (a) the near-impossibility that the weight of evidence may settle out in the other direction, and more importantly, (b) that it would matter to sex-defined categories. Because even if there was a medical regimen that could completely eliminate male advantage, it wouldn’t change the fundamental basis of the categories that the Court upholds: sex.

Fortunately, this sets the stage for Coach Kavanagh to take over Justice Kavanagh’s pen:

“Women and girls who play sports care deeply about all of those things. They obsess about them. They spend extraordinary time and effort to train in the heat and in the cold, to work out early in the morning and late at night, to get a little faster, to become a little stronger, to jump a little higher, to shoot a little better, to watch a little more video, to make the lonely journey back from an ACL tear, to scrap for playing time, to start, to win the game, to win a championship, to hang a banner, to bring home a medal, to be all-tournament, all-county, all-State, or all-American.

“They put a championship trophy or all-league award on their bedroom shelf—and it stays there forever as a reminder of their love of the game and pride in their achievements. They learn to endure losses with grace, to lift up their teammates, and to respect opponents who have beaten them fairly and squarely. They learn to win with class—to look a defeated opponent in the eye, shake her hand, and congratulate her on her effort.

“Whether the star of the team or the last player on the bench, they form lifelong friendships and lifetime memories.

“They savor their athletic accomplishments and cherish them for years, even decades, after their playing days are over.”

All of that. Every day. Not “into my veins,” because it already courses through. That’s why I’m here, as I approach the third anniversary of The Game that Changed Everything (not saying Kavanagh read that one, either).

Males and females are different. Sports are different. But men’s sports and women’s sports are equally valuable and worthy of protection, and the only way to protect them is through sex-defined categories.

Ultimately, the most lamentable thing about this decision is that it was necessary.

Update: I started this post on June 29th, when Strangio thought she was going to lose the case the ACLU was arguing that it was unlawful to organize sports by sex, and on June 30th as I was finishing this analysis of Strangio’s bizarre ramblings, the Supreme Court sided with Little and the state of West Virginia, that the 27 states that currently organize sports by sex may continue to do so. Strangio and the ACLU lost. The bad news is that the 23 states that allow choose-your-own-sex-category sports may continue to violate girls’ rights. More on this long-awaited decision in another post.

This June, New York City has been electric: the elation of the Knicks championship overlapped with the start of the World Cup, all of which unfolded against the backdrop of Pride, bringing neighbors together through joy rather than crisis. I witnessed and partook in the celebrations that unfolded around me with an enduring appreciation for the power of a shared love and community.

As a pretend man, Strangio must have noticed that World Cup soccer is made up of ALL MALE players. Surely she must notice that there are no “trans men” on any team. Worldwide. None. Why isn’t Strangio hollering about the fact that there are zero trans men in World Cup play? How could she celebrate such an exclusive, unwelcoming event? All males doing amazingly athletic stuff that males do because they’re male. Also, our gal Strangio plays with fire by bringing up Pride and soccer, because of course, those two terms in the same sentence will return Canadian mono-named sex rejector Quinn who very much is not banned from sports, despite whatever nonsensical stuff she may believe. Which shoots down Strangio’s whole carefully constructed lie.

At the same time, I had to temper this celebratory spirit with the reality of what June has brought and will bring from the Supreme Court. Last week, the Supreme Court cravenly dismissed the racism of the Trump administration and upheld some of the President’s deadly immigration policies. This coming week, we will culminate this month of sports and Pride with a decision from the Supreme Court on the lawfulness of banning trans athletes from sports, which will serve as another pronouncement from the Court on whether trans people will be included in social and civic life. When the trans sports decision comes down, I hope that everyone who, like me, loves sports will pause to think about what it means to exile a group of young people from the social, cultural, and emotional experience of being part of a team.

There she goes again, trotting out the “banned from sports” lie that even the most slavish foot soldiers of the ideology (New York Times, I’m looking at you) won’t publish. Strangio was not allowed to spew that kind of whopper under oath before the Supreme Court, but rather she argued that her male clients, Becky Pepper-Jackson and Lindsay Hecox, would be very sad if they, like every other human being in West Virginia and Idaho respectively, were required to participate in sports in their sex category. And furthermore, Strangio argued, they would be so sad about being required to follow the rules that they might just quit sports. Strangio was never allowed to say in court that her clients would be banned from sports because that’s not true. But when she’s not in court, like on her Substack, Strangio likes to pile the falsehoods into glorious steaming heaps. Because it sounds better to the empathetic public than if she just said her male clients refused to accept reality, respect women’s rights, and follow the basic structure of sports, as recently reified by the International Olympic Committee. That would just sound stupid.

Like all liars when inventing something truly monumental, Strangio had to skate dangerously close to the truth. In pointing out the obvious heinous injustice of making it unlawful for a group of people to enjoy the benefits of sports, she accurately described what has actually happened to girls in 23 states, where it is unlawful to organize female-only sports. There are no girls’ sports or locker rooms or restrooms; there are only mixed-sex sports and locker rooms and restrooms in 23 states. Twenty-three states ban female-only sports. When she paints this horrific picture of lawful exclusion of a group of people from sports, she runs the real risk of thinking people connecting some dots—Hold on a minute, where have I heard this before?

And Strangio’s stance here is mighty pessimistic. Before the decision even comes down, she’s pretty much assuming that she has lost, that Idaho and West Virginia will be able to continue to organize sports based on sex. She has not even considered in this piece the possibility that her clients will prevail. Why not spend those words on her Substack to describe how lovely it will be for “Becky” and “Lindsay” and all the boys with girl identities to be able to get all the social and emotional benefits of being part of a team that has been forced by law to accept them? Why did Strangio not use AB Hernandez in California as a glowing example of the paradise, the rightness-with-the-world that results when boys can self-identify into girls’ sports?

Growing up, I felt a profound alienation from both my body and the world that I could not place. I had no models of queerness or transness around me and no map to follow for how to find home in my body and sexuality. Middle and high school were unbearable, but what gave me peace were the experiences of being an athlete on a team. I could inhabit my body when I stepped onto the field. I could make sense of being part of the world when I was with my teammates. For years, I imagined that I would grow up to be a professional athlete. I would play soccer for the University of North Carolina and then go on to join a yet-to-be realized women’s soccer league, I genuinely believed. Of course, I would discover that I had neither the skill nor the desire for a future in soccer and more profoundly, that I was not a woman. But what mattered in those formative childhood and adolescent years, were the dreams and the drives that kept me connected to my body and the world. That is what the overwhelming majority of us get from youth sports: a structure, a set of lessons, a social and emotional home, a place to navigate our bodies through puberty. Yes, competition is thrilling and important, but it does not explain, on its own, the transformative impact that sports can have on our lives and culture.

She almost gets it. So close. She feels right with her female body, with other girls and with being a girl when playing on a female soccer team. Everything made sense. Yes, of course it did. That’s called reality. That’s why sports are organized by sex. Somehow she failed to appreciate that she was only afforded that sex-accepting experience because she was playing on an all-girls team. It was girls-only by law. It excluded boys. Why doesn’t Strangio wonder how she could have had such a positive lifesaving experience on a team that banned males? Despite “navigating” her body through female puberty, Strangio made a hard and unexplained left into I was not a woman. Even if you think of this tragic indoctrination of a distressed girl as discovering her authentic self, why then did she not seek that same transformative sense of community, of rightness, on the boys’ team? Girls’ sports was the only thing that got me through puberty, which is why I will die on the hill that girls’ sports, that beautiful social and emotional home, that transformative experience, should be destroyed by including boys who think they’re girls? I’m not a lawyer, but that is some crazy kind of reasoning.

When, at seventeen, I realized that I was queer and came out, I left my athletic “career” behind and found embodiment and community in queerness. But I never left my love for sports. A lifelong Boston sports fan, I felt a similar sense of belonging in team fandoms that I did in queerness. In college, I gathered in lounges and bars to watch the New England Patriots win the Super Bowl in 2002 and the Boston Red Sox win the World Series in 2004 and was overtaken with joy in the same way that I am when I gather in June for Pride. I recognize in all of these experiences the way that being part of a community speaks to a deep human need for connection and shared purpose. It is why, even as a Boston sports fan, I could revel in the Knicks victory; it was a transformative moment of joy for New York City, another community that has shaped my life. Our love and fandoms can even hold the contradictions of living full, complex, messy lives. Even those who abhor nationalism find themselves overtaken with an inexplicable love of country during the World Cup or Olympics. Immigrants who flee profound violence still cheer for their home countries because of deep ancestral ties that can overcome exile and cruelty. Community is transcendent in that way.

Aaah, here’s the answer. She left athletics—where she was happy, where she felt at home, where everything made sense—behind, to instead find community in a community that proudly makes no sense. Making no sense, and demanding that others respect your nonsense, is the not-very-stable foundation of queerness. Men are women, women are men, good is bad, bad is good—it’s kind of like Pajama Day during Homecoming week, but the adherents, including Strangio, never moved on. They never realized that Pajama Day is not a good way to live the rest of your life, and probably the Supreme Court is not going to buy it.

Strangio tries and fails to show that queerness or transness—ideologies that deny reality—provide the same sense of community as being a Red Sox fan or a German, both of which are based entirely and necessarily in reality. Because Mexican immigrants who fled murderous drug cartels can still cheer the Mexican soccer team does not mean they feel all chummy about the drug cartels. For the love of god. This woman is a lawyer? No no, identifies as a lawyer. And, I’m sorry, what does this have to do with boys in girls’ sports?

I thought about all of this - sports, pride, the Supreme Court - when I left my house yesterday to join the New York City Dyke March. It has been an excruciating week in the United States with the Supreme Court legitimizing the Trump administration’s grotesque immigration policies. And yet, when I left my house in the rain wearing a Colombia soccer jersey, holding a “Fuck ICE” sign, and walked down the streets of my Queens neighborhood, what I witnessed was the opposite of the cruelty on display from those in power. Immigrant business owners of South Asian descent were wearing Colombia jerseys to share in the joy of their South American immigrant neighbors. Families were still celebrating Ecuador’s win over Germany that sent Ecuador into the Round of 32. Queer people in Knicks jerseys were heading out to join thousands at the Dyke March. Everyone was profoundly joyful. Being in and part of a community is often the antidote to despair. In my life, I have found that in both queerness and in sports. Whether in the knowing smiles to fellow queers or Boston sports fans on streets around the world or in the public celebrations during Pride or championship parades, shared love can transcend almost anything.

Gosh, for a minute there, what with the cruelty references, I thought she was going to talk about how lesbians are being called gender nazis for not dating men. And how, in fact, some of those lesbians that are being excluded from queer love were undoubtedly on her high school soccer team, helping her navigate her female puberty. Not sure how BPJ threatening his teammates with rape fits into Strangio’s queer lovefest.

There are many queer people who do not understand or enjoy sports and many sports fans who do not understand queerness. But, I would submit, the majority of us understand the experience of being part of community. We understand what it means to gather together with a shared sense of purpose, embracing the same emotional register, and overcoming an obstacle or sustained adversity to celebrate what makes our shared experience special. That means we also understand that banning people from these shared experiences has long-term consequences and not just from the immediate exclusion but also from the impact of being deprived an essential human need - belonging.

Strangio misunderstands sports. And rights. And reality. Maybe this is why she lost. The only reason sports provides community is because athletes and fans trust that rules are being followed. Sports are not a vehicle for affirmation of whatever crazy-ass belief one has. One gains a sense of belonging from sports because everyone respects the rules. That’s a requirement for belonging. If you’re arguing for cheaters to be celebrated, well, you’re not going to get that warm fuzzy sense of community. It’s not Pajama Day, ffs.

So, as we close out this June - of sports and Pride - I want to urge people to fight for those moments of collective joy and shared sense of belonging. If you are replaying videos of OG Anunoby’s tip in Game 4 of the NBA Championships or you found yourself following Cabo Verde goalkeeper Vozinha’s epic World Cup run or you wait every year to join your people on the street for Pride, consider joining in a shared sense of outrage at the Supreme Court’s decisions impacting immigrants and trans people. These decisions are not only about legitimizing discrimination but also about dividing us from this human need to experience collective joy.

June is for sports and Pride. And our love for either or both, can carry on in a year-round insistence that our lives our improved when we believe in and fight for each other.

Again, why didn’t Strangio illustrate the “collective joy” and “shared sense of belonging” of the girls who were forced to share the podium with AB Hernandez? Are girls not worth fighting for? Are girls not “each other?” You know, ever since Strangio left girls’ sports behind, stuff stopped making sense. She stopped making sense.

Fuck ICE, go Knicks, Happy Pride.

Ipsos, one of the world’s leading market researchers, recently published their 2026 LGBT+Pride Survey Report, a survey they’ve conducted annually since 2021. This report provided a whopping global* picture of attitudes toward lesbian, gay, bisexual, and transgender issues, now and over the past five years—19,019 people aged 16 to 74 across 26 countries. Some things stood out to me:

• Of the 15 questions surveyed, support for transgender athletes competing based on their gender identity rather than sex was by far the lowest, averaging only 22% over the 23 countries where this question was asked. From the first report, sports was the one area with markedly lower support for “transgender rights,” at only 32% in 2021, plummeting a further ten percentage points since then. Opposition to sports self-ID is the dominant view in all countries polled.

• While opposition to sports participation by gender identity was very strong, there was equally strong feeling that LGB people (75%) and people who identify as transgender (73%) should be protected from discrimination in housing, employment, and access to businesses such as stores and restaurants. And there was broad agreement (65%) that transgender people faced “a great deal” or “a fair amount” of discrimination, but there was less support for laws banning discrimination against LGBT people (52% on average). Respondents clearly supported basic civil rights for LGB and T people (interesting that they polled the T and the LGB separately for this question), but were a little leery of laws enforcing anti-discrimination, and either they did not see single-sex sports as discrimination against people with trans identities or did not view the ability to choose which sex category one participated in as a civil right.

• Notably, across the board, in the responses to all 15 questions in all countries, support for LGBT issues declined over the past five years, including support for the cornerstone of LGB acceptance—same-sex marriage. It’s ominous that the enormous investment in and singular focus on “trans rights” by LGBT advocacy groups has not only resulted in reduced public support for trans issues, it has also dragged down hard won support for legal same-sex marriage.

• Yet curiously, Ipsos characterized the overall 2026 results as “stabilisation in attitudes towards LGBT rights.” Ipsos spun it this way: “In recent years, we’ve seen evidence of a ‘wokelash’ on many key metrics, and across a number of countries. This latest release reveals a more nuanced picture, with attitudes stabilising on a series of measures, continuing the trends observed in the 2025 Pride report.” A drop in support of LGBT issues across all 15 questions surveyed in every single country does not add nuance or show stabilization—it confirms a universal, global continuation of decreased public support for LGBT issues.

Support for sports participation according to gender vibe has always been low, and has dropped from there

The question was posed as:

To what extent do you support or oppose the following: Transgender athletes competing based on the gender they identify with rather than the sex they were assigned at birth.

The average percentage of respondents who supported participation by gender identity in the 23 countries in which this question was asked was 32% in 2021, 27% in 2024, and 22% in 2026. Those respondents who stopped supporting choose-your-own-sex-category didn’t just switch their response to “Don’t Know,” they actively opposed sports participation by gender identity.

That drop in support was evident in every single one of the 23 countries surveyed on this question, including in countries that were heartily on board with other trans issues. For example, Spain topped the charts in nearly every measure of support for trans issues: In 2021, 50% of Spanish respondents supported sports participation by self-ID; by 2026, that support had dropped to 29%. Countries that were largely supportive of other trans issues, and had started out in 2021 accepting of choose-you-sex-category more than most countries—Sweden, the Netherlands, Belgium, Germany, Canada, Brazil, and Argentina—dropped precipitously by 2026. The United States started out in 2021 with only 27% supporting and ended in 2026 with 21%. Great Britain respondents registered a mere 24% in support of gender identity-based sports in 2021 and by 2026, that feeble support had fallen to a mere 15%.

This is not a nuanced response. This is a global condemnation. Of men in women’s sports. Not, for the love of god, a trans genocide. (Although by continuing to push for gender identity in sports, trans activists have already dragged down support for all other trans and, critically, LGB issues. In hyperbolic transspeak, that may be the self-inflicted genocide they shout about). Either the public doesn’t view single-sex sports as discrimination against people with trans identities, or respondents don’t think that choosing one’s sex category in sports is a civil right on the order of housing, education, employment, voting. Or, and this is a long shot, they see that sports participation by gender identity comes at the expense of women’s rights to single-sex sports. Or all of those factors.

Sports participation by gender vibe is and always has been a phenomenally unpopular issue with the public. Why that one situation? Why are people really opposed to men in women’s sports, and not as much men in women’s restrooms (Ipsos reported average okay-ness with that of 47%)? Is it because sports has rules and categories to preserve fairness but bathrooms do not? Is it because almost every person on the planet has personal experience with sex differences in sports, but comparatively few have shared the ladies’ with a dude? Is it because sports performance can be objectively measured but feminine mimicry and subsequent creepiness response is squishy?

By continuing to push for self-ID in sports, when public support is very low and scientific support absent, trans activists have sacrificed LGB and T acceptance in all areas

Of course men in women’s prisons is the ultimate trans activist overreach, the ultimate test of how far activists could push the mantra A Trans Woman Is A Woman. But the prison population is small and, thanks to deliberate media suppression, very much out of the public eye. Not so with sports. Virtually every human has some personal experience with sex differences in sports. Sports are avidly followed globally by billions of people. Sports science is one of the most robustly studied fields. For those reasons, sports was always going to be gender identity’s Waterloo, a losing game. Activists didn’t need Ipsos to tell them that. They could have jettisoned sports self-ID to focus on more winnable, public-friendly areas like research, health care, housing, employment. Nope. They went with the all or nothing approach, maybe thinking if they started allowing exceptions to A Trans Woman Is A Woman, say, except for sports and locker rooms where A Trans Woman Is A Man, then maybe a Trans Woman Is Also A Man in prisons and rape crisis centers and bathrooms and hospital wards. And breastfeeding support groups. You can’t sell the idea of a part-time Trans Woman. It’s a full-time fantasy. Martin Rothblatt and company knew that way back, so, damn the public, they pushed for sports self-ID. And predictably, their absurd claim that play-by-feels is a civil right is endangering the whole enterprise.

The first time Ipsos asked this question about sports participation by feels in 2021, public support was only 32%, lower than for any of the other issues surveyed. With continued exposure over the next five years to sympathetic stories about people with trans identities just doing the sport they love and not hurting anyone (gotta love those women who identify as men but continue to have a fabulous career in women’s sports thanks to the fact that there are women’s sports) and in many cases, knowing someone’s dear sweet son who was born in the wrong body and is now playing on the girls’ basketball team, those respondents could have changed their mind and become more accepting of people playing according to their identity. But they didn’t. With five years of relentlessly positive media exposure to sports self-ID, not only did they not become more supportive, more of the few people who had supported men in women’s sports changed their minds and opposed it. The more exposure, the more they educated themselves, the more trans stories they heard and the more trans people they met, the less supportive they became.

This process of public education may be playing out in other areas, bathroom use, for example. Ipsos worded the question this way:

How much do you agree or disagree with the following? Transgender people should be allowed to use single -sex facilities (e.g., public restrooms) that correspond to the gender they identify with.

In 2023 when Ipsos first asked this question, an average of 55% of respondents across 26 countries agreed with this policy. So bathroom use by gender identity enjoyed more support from the get-go than sports self-ID. By 2026, that metric has slipped to 47%. Other than Thailand (I’m throwing out Thailand because the lady-boy phenomenon there is unlike the trans issues in the rest of the world), in every country, agreement with this statement slipped in just three years’ time, sometimes dramatically. The Netherlands and Spain, both very trans friendly places, went from 65% agreement to 56%. Great Britain went from 40% in agreement to 30%.

Again, with all 15 questions, every country, acceptance or support for LGBT issues decreased. The most damning of these is support for same-sex marriage. This is the seminal, decades-in-the-making achievement of the gay rights movement. And most people thought it was a done deal. But since LGB was force-teamed with T which subsequently became almost the sole focus of LGBT organizations’ efforts and resources, lesbian and gay people have paid the price for trans overreach. Ipsos posed the question this way:

When you think about the rights of same-sex couples, which of the following comes closest to your personal opinion? Same-sex couples should be allowed to marry legally; Same-sex couples should be allowed to obtain some kind of legal recognition, but not to marry; Not Sure; Same-sex couples should not be allowed to marry or obtain any kind of legal recognition

On average of the 23 countries polled, those who responded same-sex couples could marry or be legally recognized stood at 74% in 2021, and by 2026 had slipped to 66%. Only one country—Germany—registered the same degree of acceptance for same-sex marriage over the five years. While still generally high, the other 22 countries all showed decreased acceptance of same-sex marriage. Again, we don’t know why respondents answered the way they did but the fact of loss of social acceptance of all things LGBT is undeniable, global, and ongoing.

Or the Washington Post. Or virtually any major news outlet. I pay attention to this septic tank, and I was surprised by Ipsos’ findings. The respondents to this question voiced their opposition, anonymously of course, even though, from what they have gathered from the media, they were a bigoted minority. Imagine if The New York Times accurately reported that a dismal 21% of Americans supported self-ID in sports, and 55% oppose it. Imagine if all those respondents knew they were not alone in their views, that they were in fact the vast majority. Might they be more open about their views? Might they demand accuracy by the media and action by political leaders?

As tremendously unpopular as self-ID (and to be clear, that’s men in women’s sports) is globally, here in the US, we are waiting to see if the Supreme Court will decide it’s constitutional to have girls-only sports. Or not. Twenty-three states flout federal law and enforce the spectacularly unpopular, anti-science, anti-woman policy of choose-your-own-sex-category sports. And this is considered both progressive and democratic when it is neither.

I wake up every morning in a state which has erased women’s rights in favor of men who think they are women. A man who claims to be a woman won a lawsuit in which he also claimed he was discriminated against for being denied entry into a women’s powerlifting competition. Girls in my state who filed a lawsuit claiming their Title IX rights were violated because a male was on the roster of an opposing softball team did not even get to court because the court decided they had not proven they were harmed. A 15-year-old girl in Washington who was not informed she would be wrestling a male, and was subsequently sexually assaulted on the mat. Her lawsuit was dismissed because apparently when you sign up to wrestle, you consent to being digitally raped.

This is the water I swim in, and lately, have sort of been drowning in. It came as quite a surprise that very few of my Earthly cohort think this is remotely okay. Huh. Context is everything. Bonus brain gooser: The global organization that compiled the data tried to downplay the very clear message that trans as a product is losing its luster. Double huh.

*Ipsos did not survey Russia, China, India, any country in Southeast Asia, the Middle East, or the continent of Africa, so when I say global, I’m speaking Euro-centrically. Where toilet paper brands are a thing.

New Richmond, Wisconsin is a relatively conservative town, so it caught my attention when I heard a news report this past winter of a heated school board meeting over a boy who had been allowed by the school to use girls’ restrooms. Of course, this is an everyday occurrence in neighboring Minnesota, where “girls’” bathrooms, locker rooms, and sports are merely state-facilitated lies, but Wisconsin schools and sports recognize sex-based sports and restrooms. The New Richmond School District quietly and unilaterally violated state and federal law to allow one male student to use the girls’ restrooms.

This is a textbook example of one gender activist capturing an entire organization. Though it violated state and federal law. Though the majority of the school board, the students, the parents, and the community supported single-sex bathrooms. That wasn’t enough to counter a tiny number of trans zealots. It took courage. Someone had to speak out and put their name to it.

New Richmond High School junior Ella Frei was that person. She spoke out at a school board meeting, on social media, on podcasts and news reports. I spoke with Ella by phone.

The Female Category: Was there a specific incident that made you want to speak out publicly?

Ella Frei: My school had a bathroom policy that they were allowing a biological boy into the women’s restroom and that’s when I first went on Moms for Liberty, talking about it, and there was a protest in my town about it, because I thought, that’s not ok, there shouldn’t be a boy in the women’s restroom. And the school board wasn’t addressing it. They were putting up signs, maps to where the single-stall bathrooms were, for girls who were uncomfortable sharing their bathroom with a boy. And that’s when I went on the internet. A couple days ago I was on a podcast with Scarlett Johnson and Lindsey [Moms for Liberty hosts] and somehow AB Hernandez came up. I do long jump in my small town—I’m not very good—but if I had to go against a male I don’t know what I would do. That’s a crazy position to be put in. So, there’s not anything personal in sports in my school, but with the bathroom stuff ging on at my school—this is where it starts. It starts with the bathroom, then it goes to the locker rooms, then it goes to sports programs.

TFC: I just looked up Wisconsin Iinterscholastic Atheletic Association and saw that, as of February 2025, they banned trans girls—boys—from girls sports. Maybe you don’t know this, but why would your school then allow boys in the girls’ bathrooms? It’s against Wisconsin state law.

Ella: That’s the question everyone was wondering because they’re not complying with Title IX. The US Department of Education filed an investigation into the school.

TFC: When did you become aware a boy was using the girls’ restroom? Wait, are you a senior?

Ella Frei: I just finished my junior year. About halfway into my junior year. There’s a school board meeting in the winter where it was hot. A bunch of parents found out a boy was using the girls’ restroom, everyone was concerned, and that’s where I did a speech that Scarlett from Moms for Liberty posted and it went viral. And that’s when the Department of Education said they were going to investigate my school.

TFC: There was no announcement by the school about this bathroom policy? This boy just started using the girls’ bathroom?

Ella: Yeah, that’s why the parents were mad. They never sent out an email or anything.

TFC: To your knowledge, that boy has not used the girls’ locker room or been in girls’ sports?

Ella: No, not yet.

TFC: What has been the reaction among other students to your speaking out and protests about the boy in the girls’ bathroom?

Ella: Some students are against everything. They started a Facebook page against Moms for Liberty, and they’ve been harassing me, bullying me online, as well as some teachers who were engaging in that. But there’s also a huge group who are really proud of what I did. I have people come up to me every day; I was at a track meet recently where someone came up to me and said, I heard what you did at your school, that’s really cool. And I had a lot of friends that were there at the school board meeting who were too scared to speak up but were really glad that I did. We were too scared to even tell anyone about the boy in the girls’ restroom because we thought there would be retaliation. So a large number of people agree with me.

TFC: So they are aware this is a Title IX violation? They do know about Title IX rights?

Ella: Yeah.

TFC: Adults, too, are afraid to talk about this it seems. Why do you think there is this fear of saying something so obvious as a boy should not be in girls’ bathrooms? Where is this fear coming from?

Ella: Nobody wants a big target on their back or to be viewed differently publicly. Like at that school board meeting, I thought, once I do this, everyone’s gonna know what I think. I’m the face of it. I’m glad that I’m the one that’s doing it because I can take it.

TFC: Why is that? Why are you the one to take it?

Ella: For me, I would rather have it stop now than down the line. I think there’s a lot of girls that, I don’t want them to come into high school and have to deal with this. And also, I have so many people on my side, saying You got this. And these younger girls can have someone to look up to, and feel safe in our school. Hopefully they’ll never have to say, Oh I can’t go in there because there’s a boy in there.

TFC: Correct me if I’m wrong, but New Richmond seems like a fairly conservative town. It strikes me that, even in this town where probably 90 percent, or more, of the people believe boys should not be in girls’ restrooms, well, first, it’s strange to me that this policy was made in the first place, and, second, that people would be afraid to say anything about it.

Ella: What I think it boils down to is there was one person on the school board who disagreed with everything, and he was kind of the president of the school board..

TFC: When you say he disagreed with everything, what do you mean by that?

Ella: Well, someone recommended they do a temporary single-stall restroom for the trans student. And that was completely denied, immediately [by the school board]. It was mostly this one person who shut that idea down. I think we let the wrong people have power over the decision of the girls. Like our needs were getting pushed out of the way, and when we expressed how we felt, they didn’t care.

TFC: How was your speech, and any other girls who spoke at the meeting, how was that received by the school board?

Ella: It was kind of mixed. There were a lot of parents agreeing, applauding girls who did speak up, but there was a group of kids and their parents who started yelling and getting crazy, and the whole board sitting up front, they didn’t even care. They wouldn’t hold eye contact or anything. They did this to the kids and couldn’t even look at us. They knew what they were doing was wrong but they didn’t care.

TFC: Have you met with the principal, or had any feedback from the principal?

Ella: Not really. The principal is super nice but she didn’t really have a say in everything that was going on. It was the school board taking control.

TFC: What was the reaction on social media? You mentioned you had received some bullying.

Ella: After the Moms for Liberty podcast, it was definitely crazy. There were kids hating on me publicly online, and in school they’d talk to other kids, but would never say it to my face. That’s where the whole online thing comes in—they’re braver online than in person I guess.

TFC: The kids who think the boy deserves to be in the girls’ bathroom—what is their argument for it?

If they just had a policy for him from the very beginning, instead of for us. Like have him go to the single-stall bathroom instead of all the girls.

Contrary to the mendacious claims of Attorney General Keith Ellison, and the Minnesota State High School League (MSHSL), it is not illegal discrimination to restrict athletic teams, athletic events, locker rooms, and bathrooms to one sex. Why are they promulgating this human rights violating lie? That’s the rabbit hole I went down.

There are two clearly written exemptions to that oft-cited sacred text (which, like other sacred texts, few of the pious have ever read), the Minnesota Human Rights Act that enshrines both sex and gender identity as protected characteristics. One is under Exemptions Based on Education, with a clause on Athletic Teams:

Subd. 2.Athletic teams. Notwithstanding any other provisions of this chapter or any law to the contrary, it is not an unfair discriminatory practice for an educational institution or a public service to operate or sponsor separate athletic teams and activities for members of each sex or to restrict membership on an athletic team to participants of one sex, if this separation or restriction meets the requirements of section 121A.04.

Another is under Exemptions Based on Public Accommodations, with clauses covering restrooms and locker rooms, and non-school athletic teams and events:

Subdivision 1.Restrooms, locker rooms, and similar places. The provisions of section 363A.11 relating to sex, shall not apply to such facilities as restrooms, locker rooms, and other similar places. The provisions of section 363A.11 do not apply to employees or volunteers of a nonpublic service organization whose primary function is providing occasional services to minors, such as youth sports organizations, scouting organizations, boys’ or girls’ clubs, programs providing friends, counselors, or role models for minors, youth theater, dance, music or artistic organizations, agricultural organizations for minors, and other youth organizations, with respect to qualifications based on sexual orientation.

Subd. 2.Athletic team, program, or event. The provisions of section 363A.11 relating to sex, do not apply to restricting membership on an athletic team or in a program or event to participants of one sex if the restriction is necessary to preserve the unique character of the team, program, or event and it would not substantially reduce comparable athletic opportunities for the other sex.

They are as they appear, self-evident, there for anyone to read. Yet there is an omerta about their very existence, a concerted campaign by agencies, whose job it is to inform Minnesotans of their rights, to deny these vital women’s rights exemptions’ existence, and a bizarre near-total refusal of any legal expert or legislator to explain their meaning and use, and when or if they’ve ever been successfully used (spoiler: they haven’t). Since most organizations, most average citizens, don’t read the law or trust themselves to understand it, every Park and Rec department, school, sports organization, and health club in Minnesota believes that it is illegal discrimination to organize single-sex teams, events, bathrooms, and locker rooms.

My quest to find out why these single-sex exemptions are, in the words of AI, “dead letters,” has been both a trip through the Twilight Zone and a brutal awakening. One of the few attorneys willing to talk to me said, “You’re trying to find logic where there is none.” All I found was legalistic sleights of hand, women’s rights obliterated by linguistic tricks and technicalities, women’s sex-based legal protections with “a functional utility score of exactly zero,” and how sickeningly common it is for judges to pick and choose which laws and whose rights they will uphold and which laws they will ignore.

If you want the short and brutal truth: On paper, women have rights because, as a civil society, we like to think we believe that. We talk the talk. In Minnesota, and elsewhere I suspect, actually honoring women’s rights is a choice by policymakers, judges, legislators, and when men’s right to make society bend to their subjective ideas about themselves comes up against women’s sex-based rights, gender identity has won every time.

But stick with me. Partly because of sunk cost—I’ve spent so much freaking time and effort just trying to get lawyers, legislators, policymakers to even acknowledge that those exemptions exist—I’m going to show my work. This consists of an off-the-record conversation with a civil rights attorney, an email exchange with a legal counsel for USA Powerlifting, an explanation from Gemini AI, and a case in Australia (yes, the same Australia that Sal Grover has shown to be a leader in national delirium) where a similar single-sex exemption WAS used to its intended effect.

USA Powerlifting lost because they banned “transgender women” from the women’s category, instead of “males”

This case turned on the use of an ideological term instead of a biological one, a technicality. Because it was adjudicated by the Minnesota Supreme Court, it sets a precedent. Word choice had the nuclear effect of making non-school women’s single-sex sports events illegal in Minnesota.

USA Powerlifting refused to allow male powerlifter JayCee Cooper to compete in the women’s category because their policy bans “transgender women” from the women’s division. Cooper sued USA Powerlifting, claiming in part that he was discriminated against based on his gender identity. The court sided with Cooper.

USAPL cited the Public Accommodation exemption to the MHRA. The court agreed that USAPL had the right to organize their events based on sex, so having a male and female category was not discriminatory, per the Public Accommodation exemption. It was the wording of USAPL’s policy that tripped them up. Perhaps out of misplaced respect, the policy bans “transgender women” from the women’s category, citing a person’s gender identity rather than their sex. Attorney for USAPL Ansis Viksnins responded by email:

“We did argue that Cooper is biologically male and thus ineligible for the women’s division. But the USAPL policy did not categorize competitors as biologically male or biologically female. The policy was that transgender women should not compete in the women’s division. Because the classification implicated gender identity, Cooper was able to argue that the classification was based on gender identity and that excluding someone from public accommodations based on gender identity was unlawful.

Cooper focused on the fact that Minnesota law makes gender identity a protected class (just like sex, race, age, etc.) and that USAPL’s treatment of her was based on her gender identity. Obviously, we disagreed with her argument and explained that the exclusion from the women’s division was based on her biological sex and physiological advantages, but the fact that the state statute explicitly covers and protects gender identity caused the district court (and eventually the state Supreme Court) to conclude that the exclusion of Cooper was unlawful discrimination based on gender identity.”

Nonsensically, the court admitted the reality of sex and sex protections in one part of the case, and ignored it in the other. That he is male and ineligible for the women’s category was known but the judge chose to recognize his gender identity rather than his sex. Cooper won on a technicality. But because an activist judge decided to ignore Cooper’s sex, this case sets a precedent for other males who sue to compete in women’s sports. That gender identity trumps sex. Women’s rights turned on a stupid word game.

Or the MHRA exemption could add the words “regardless of gender identity.” Attorney Viksnins told Outkick:

“I think there are things that the Minnesota Legislature could do — fairly small and easy fixes to the statute [single-sex exemption] that would make clear that in athletic competitions, it is not a violation of the Human Rights Act to categorize transgender women as biologically male, and that would be a relatively easy fix.”

Adding the words gender identity to that exemption is small but it is in no way easy, because doing so would make the single-sex exemption effective. And modern Democrats who have been in political power in Minnesota for decades, don’t want that. They want it to sit there prettily, as window dressing, so that they can point to it as proof of their support of women, but very much don’t want it to be effective. Civil rights lawyer: Using the Education single-sex exemption, a school could ban males from female sports and locker rooms. Using those words. They would be challenged in court, of course. It hasn’t happened because there simply are not a lot of courageous people out there

That’s some of the off-the-record background information I got from a Minnesota civil rights attorney who acknowledged the existence of, and was familiar with, the single-sex exemptions to the MHRA.

These exemptions were originally written in 1973, and were very purposely and necessarily retained in 1993 when sexual orientation, which was understood to include people whose identity did not conform to generally accepted ideas of maleness or femaleness, was added to the MHRA. These exemptions were again retained as a necessity to protect girls’ and women’s sports and spaces when gender identity was explicitly added to the MHRA in 2023. They could have been left out if lawmakers intended gender identity to override sex, but were retained because lawmakers saw that adding gender identity without making the exemption for single-sex athletic teams COULD mean the end of girls’ sports. Keeping the option for single-sex teams and spaces was a requirement; otherwise the addition of sexual orientation and gender identity would not have passed. The intent of adding sexual orientation and gender identity to the MHRA was to ensure that gay and transgender people would not be turned away from jobs, housing or education. The necessities of life. It was never intended to provide for boys to be in girls’ sports and locker rooms. Thus, the single-sex exemptions. Although the court has a duty to consider the intent of the law when written, activist judges frequently ignore original intent. As did the judge in the Cooper v USAPL case. That the Minnesota Supreme Court ruled in Cooper’s favor in that case has, for practical purposes, has rendered the Public Accommodation exemption useless.

Not so the Education exemption that affects school sports, locker rooms and bathrooms. The Minnesota State High School League (MSHSL) worked their quiet misogyny here. The MSHSL, a private entity that organizes and administers all high school sports and activities in Minnesota, decided to allow students to participate in sports and activities, and use bathrooms and locker rooms according to their gender identity in 2014.

In doing so, they ignored Title IX, the single-sex exemption in the MHRA, and virtually all science and data around male advantage in sports, and male pattern sexual behavior.

Why?! My god, why would anyone vote for that (the vote was 18-1 in favor, with one board member abstaining)? Simple. A powerful mix of ignorance, cowardice, unwillingness to go against the grain and seem unkind or not progressive, misplaced compassion, not thinking it all the way through, not thinking of all the angles. Re: ignorance, one of the reasons mentioned by the MSHSL board for “opening up” girls’ sports to boys is that girls already were allowed to participate in boys’ sports. Yes, really. When a girls’ sport did not exist, girls could participate in boys’ sports, like football or wrestling. The number of girls who availed themselves of this opportunity was tiny, and the number who used the boys’ locker rooms and restrooms, and took varsity spots away from boys was functionally zero. That they believed boys in girls’ sports and locker rooms would behave in exactly the same manner required a virulent brand of stupid, but the MSHSL board managed it. Charitably, in 2014, the MSHSL board could not foresee that transgenderism would blow up culturally, to the point of overriding the reality of sex. They were desperately wrong.

Now 12 years later and much wiser, to their great shame, the MSHSL has doubled down on violating girls’ rights. They are under investigation for Title IX violations by the Department of Justice.

Schools vote every year to be a part of the MSHSL but because MSHSL has a virtual monopoly on sports and activities, a school that opts out of the MSHSL would effectively have no extracurricular activities. If they want school sports and activities, then they must be a part of MSHSL and go along with their girls’ rights violating policy.

A women’s netball team in Victoria, Australia used a similar single-sex exemption to ban males. And it worked! No lawsuit, no male tantrums, no fuss, no muss

As I fruitlessly emailed and called the media relations teams at Mitchell-Hamline and the University of Minnesota Law Schools, I happened across the redoubtable Fraser Anderson and his stunningly similar story about a netball club in Australia, with a startlingly different outcome.

The Riddell District Football Netball League (RDFNL) , a women's netball competition, quietly did something that the entire apparatus of Australian sport administration has spent several years insisting was legally impossible, politically catastrophic, and probably a hate crime. They told two men who had presented themselves as women that they would not be playing in the women's competition. No tribunal. No twelve-month review process. No crisis communications consultant. No weeping press conference. They cited Section 42 of the Sex Discrimination Act, the men's representatives mumbled something and withdrew, and the women played netball. The earth continued to rotate on its axis. Nobody died.

You will, I suspect, not have read about this in any of the places that breathlessly report every incremental advance in the project of making women's sport compulsorily inclusive of men who find the arrangement convenient. That is because the story contains a piece of information that the relevant institutions have a very strong interest in keeping as quiet as humanly possible: the legal instrument to protect women's single-sex sport already exists, it is already in the federal statute, it already works, and it is written so precisely that opposing it in court would require an argument so legally contorted it would put your barrister's back out.

Very pleasant reading on a number of levels. Anderson goes on to point out that the response by the Australian Human Rights Commission to this stunning bloodless victory using one of its lesser advertised laws was radio silence. Yes, these are the miscreants who have sided with male Roxy Tickle in his four-and-a-half-year quest to be able to join Sal Grover’s all-women’s app so that he can ask the sisters how they deal with five o’clock shadow.

As in Minnesota, there seems to be a coordinated campaign to NOT let women and women’s sports organizations know that this single-sex exemption exists in law. The AHRC, whose job it is to enforce anti-discrimination law, went out of their way to keep women from knowing they had a right to single-sex sports, AND at the same time, actively promoted the idea that men with feminine identities should be accommodated. All of this had a very familiar ring to it.

As you will not be surprised to learn, the vastly different outcomes for the Riddell Netball Club and USA Powerlifting come down to three words in the Australian exemption to the Sex Discrimination Act.

Section 42 of the Australian Sex Discrimination Act 1984 allows for the exclusion of persons from competitive sports based on sex, gender identity, or intersex status if strength, stamina, or physique are relevant. This exception generally applies to sex-segregated sports but not for children under 12, coaching, umpiring, or administration

That this law states that people can be excluded based on sex, gender identity or intersex status (they covered all their bases!) closes off the absurd loopholes that have been leveraged by JayCee Cooper and others in the US. But even as comprehensive choice of words served women in one instance, the rest of the words—if strength, stamina, or physique are relevant—made this law useless to Sal Grover.

Again, to protect women’s rights requires extraordinary care with words. As if there is no true understanding of women as the other distinct sex class of human. Men, yes. Men are a fully defined entity, solid, real, deserving of rights and entitlements. Not so women. The word women is open to interpretation, full of loopholes.So many, it’s impossible to close them all off.

Instead of the many thousands of girls and the whole massive healthy functioning girls’ sports ecosystem absorbing one boy-with-a-girl-identity, turning him into a “girl” by “inclusion,” that one boy infects ALL of those thousands of girls and perverts the whole girls’ sports enterprise—athletes, coaches, California Interscholastic Federation, schools, fans, media. There are no winners; everyone loses. It is the reductio ad absurdum of transgenderism—the public degradation of sport and the rape of reality.

For comparison, here’s how it would look if AB Hernandez was a girl. I.e, how sports normally work

If Hernandez was a girl, well, he simply wouldn’t have achieved the kind of dominance he has in the girls’ category. No girl has achieved this level of national dominance across three events. Notably, no boy competing in boys’ sports has either. This kind of dominance can only happen when a male is allowed to compete in female sports. Doing this well in even one jumping event is amazing. Achieving top-15 national rankings across three different jumping disciplines is pretty much unheard of.

For example, among the top 15 girls in the nation in these events, athletes D’Anna Cotton (#2 triple jump, #7 long jump), Kira Grant Hatcher (#10 triple jump, #6 long jump), and Madison Cuplin (#8 triple jump, #1 long jump) are ranked in two jumping events, but not all three. No boys are even in the top 15 in two of these events, let alone all three.

Hernandez appears to be uniquely advantaged among high school “girls” in demonstrating elite national rankings simultaneously in the triple jump, long jump, and high jump. If Hernandez was female no one would be claiming his performances were unfair or that he didn’t belong. A girls’ outstanding athletic performances would be celebrated, not questioned. Female champions are generally magnanimous toward their co-competitors and humble, not bitter and defensive. Like Lance Armstrong on the ropes, Hernandez told media, “They picked the wrong girl. I mean, half of the girls are on my side so…I did what I wanted to do…” Narcissism is not a celebrated trait of track champions.

If Hernandez was female, he would not feel the need to perform exaggerated girlhood. Some girls wear makeup in a competition and some do not, but no female champion has felt the need to prove her girlhood in addition to her jumping skills. Why would she? It’s a track meet, not a Halloween dance. In the same way that Dylan Mulvaney flailing around in a sports bra was a grotesque distraction from the product, calculated drag-like makeup, bows in his hair, head tilt and simpering mannerisms shift the focus from athletics to a boy doing an insulting girl dance.

Female track champions focus on track. Hernandez focuses on acting. Every minute of every day. It’s about acting—sports just happens to be the stage he’s on. His performance, the one everyone notices, the one he’s putting energy into, is not inspiring or admirable, it’s sad.

If Hernandez was a girl, his co-competitors would not be asked by media how they feel about competing against him

If Hernandez was a girl virtually no media would be interviewing the second place finisher in the high jump at a high school meet. If Hernandez was a girl, the female athletes being interviewed, not about their athletic performances but about another competitor’s maleness, would not have to filter and censor their feelings, their facial expressions, their actions, and their words. They wouldn’t have to act. Competitions are a festival of emotions—anxiety, focus, elation, disappointment—and athletes express those emotions openly. That’s normal. But pretending a co-competitor is not male is being forced into a painful performance: Being extra nice, exaggeratedly kind, not bigoted at all, so so accepting of this painted cartoon-of-a-girl, laughing at his jokes, suppressing any hint of resentment, anger, disbelief, disgust. There’s no camaraderie. They’re not supporting a teammate, they’re being coerced to support a boy. To support transgenderism. A lie.

Example A: Some girls were interviewed by Outsports and they gushed that they had absolutely no problem with him, he was a great competitor: “I still would have gotten second place..” Never has a female athlete been happier to share second place. With a boy. Cringe-worthy Stockholm Syndrome.

The sad truth is these girls have grown up in California with the message since kindergarten that boys are girls if they say so. Be kind. Who are you to say this person is male? Here’s the result of that indoctrination. In addition to social opprobrium for speaking up, most of these girls, the top jumpers, are banking on a college scholarship. If they speak up about a male competitor, that scholarship will be in question. Troublemaker. Best to be a cheerful patsy team player.

Reese Hogan and Olivia Viola would not have been on Fox 9 News talking about the unfairness of boys in girls’ sports if AB Hernandez was a girl. Hogan and Viola have had to become activists as well as athletes, a role most of the adults in California are unwilling to perform. High school female athletes do not normally have to take on a highly political, socially and literally risky, high stakes public role in addition to their role as athletes.

One boy in girls’ sports has turned female athletes into either smiling, clapping props in an ideological play or high stakes activists.

The CIF, whose job it is to make sports fair, have knowingly enforced unfairness

To be clear, the CIF knows and admits that Hernandez is male and that allowing him to compete in girls’ sports is unfair. But rather than simply directing Hernandez to compete in his sex category and thereby correcting the unfairness, they have tied themselves into knots, making up special rules to allow the unfairness to continue but maybe not be as unfair to girls. The CIF, a decades-old massive institution, is no longer a sports governing body but is now in the business of managing PR for trans ideology. Regardless of how humiliating it is, this is their new role, in service of one boy in girls’ sports.

Last year, Hernandez topped the podium all season long, besting the competition in three events by outrageous margins, the unfairness impossible to ignore. Just before the state meet, the CIF scrambled to make up a special, one-time, state meet only, jumping-events-only rule stating that if Hernandez placed first, second, or third, the first, second, or third place girl would also receive that award. See? The boy-who-identifies-as-a-girl award and the actual girl award. There is no precedent of this in sports. Because it’s not sports. It’s gender identity applied. And that happened. And everyone pretended it was not the stupidest, most insulting, degrading display ever. Not proud, not inspiring, not sports. Not a solution, a capitulation.

This year, the CIF, demoted to huckster outside the circus tent, has quietly allowed 10 athletes to continue on from the section to the state meet instead of the usual 9, just in the three events in which Hernandez competes.

Jurupa Valley High School has a two-sport, multi-state championship winning, nationally ranked athlete who they do not mention on their website, nor on the Outstanding Seniors feature on Facebook.

If Hernandez was a girl, the school would trumpet this once-in-a-generation athletic talent from the rooftops. What a boost for school spirit! The coach would be a hero, he’d be quoted in the media. The track team would be elevated by association. But they know he’s male. They know it’s cheating. No one wants to claim credit for that. There’s no glory in it. Outstanding accomplishments are shameful. Don’t mention it. That’s not normal for school athletics. One boy in girls’ sports has broken high school athletics.

Hernandez’s gender identity consumes all media. Female athletes—athletics in general—have been ignored.

Sports media exists to highlight outstanding athletes. If Hernandez was a girl, well, if Hernandez was a high school girl, he would not have dominated three events, in California or nationally (see Greg Brown’s analysis above). A talented high school female athlete who was nationally ranked would have garnered some local news coverage and DyeStat might have given her the time of day, but it wouldn’t have made a blip in national news. But it did. Because news sources know Hernandez is male. Did some girls, or boys, put up some amazing performances at the Yorba Linda track meet? Probably. But sports was ignored. The focus was on Hernandez’s gender identity—not training or coaching or technique. The story was transgenderism, not sports. The only time girls were interviewed was to ask them how they felt about competing with a boy. One boy in girls’ sports has broken sports media.

This is not how sports work. None of this is normal healthy behavior, for individuals, for institutions, or for sports events. One boy competing in girls’ sports has literally broken the entire girls’ sports ecosystem and turned it into a sideshow. Shameful, humiliating, grotesque.

According to inclusion advocates, this is a transgender success story.

The Minnesota Star Tribune, Yahoo Sports, MSN, and virtually every LGBTQ media outlet on the planet shouted in Bodoni Bold that Minnesota semi-pro women’s soccer team, the Aurora, signed their first transgender player. Isaac Ranson was a standout goalkeeper for Cal State Fullerton’s women’s soccer team, where she came out as lesbian her freshman year and later in her college career, as a “trans man.”

In interviews, Ranson obediently toed the trans line, saying, “I want people to be more aware that, hey, there are trans athletes, but we’re not bringing the sport down or being unfair about it,” and encouraging other trans kids to show up “as their authentic self(?)” But then she had to turn around and ruin it all by saying she felt “safe, included, supported, and proud” to be in women’s soccer. Not a victim. Not genocided. Not banned. Fully existing, in fact, valued, embraced. Not hated. No hate.

Unless you count the “no hate” hate Ranson received from man-with-a-feminine-identity Ari Drennen, who wrote on his Substack A Trans Man on a Woman’s Team is Nothing to Celebrate: “A trans man signed to a women’s team because the league has classified him as a woman, on the condition that he forgo the medical care that would change that classification, is not a milestone for trans inclusion. It is the policy outcome the right has been engineering for nearly ten years.” Aside from the fact that it was not the right in the last ten years, but rather Biology itself for the last, I don’t know, billion years that engineered Ranson’s participation in women’s sports, Drennen and others in the Flat Earth Society are finding “trans men’s” happy acceptance in sports in their sex category extremely inconvenient for men like him who have been insisting everyone hates trans people because of their identities, and that “trans women” will spontaneously combust if they can’t be in women’s sports. Or as man-who-identifies-as-a-woman Joanna Harper pouted, “we would rather not participate at all” than have to compete in their own sex category.

In fact, all the hate Ranson received came from the kind people in the trans community. Of such startling logic, and so illustrative of the radioactive level of misogyny in that not-at-all-totalitarian community were these brilliant takes, I thought it best to Let Them Speak.

A previous post in which I chatted with held Myron Genel’s feet to the flames ended on a bit of a low note, what with the IOC honoring the insane demands of two unwell men that led, eventually, to the violation/erasure of women’s sports as a legitimate category—all sports, in all countries, at all levels, from elite to grassroots. Pretty much of a bummer.

Here, we walk it off. This time we’re going to look at the major management miracle that was announced by the IOC on March 26, 2026 —an about face, a brisk, no-nonsense, refreshing return to sanity. When I say miracle, this was nothing less than turning the behemoth IOC barge, with its bow already hanging over the falls and the current pushing hard, 180 degrees in one year’s time. More than simply deciding to follow science, the new IOC leadership had to first wrest control of the steering wheel.

IOC president Kirsty Coventry, Medical and Science Director Dr. Jane Thornton, and members of a working group are the architects of this master class in institutional deprogramming. Since this policy affects only Olympic-level sports per se, the vast number of organizations who regulate eligibility for the other 99% of female athletes must go through a similar process of policymaking, facing similar institutional challenges. It might be instructive to look at how Coventry, et al were able to break the grip of ideology at the IOC, ideological capture that had been entrenched for 23 years.

Fiona McAnena, Director of Campaigns at Sex Matters, and Jon Pike, Professor of Philosophy at The Open University and ethics of sport author, provided some insights.

How To Liberate a Captured Organization

Step One: Get New Leadership

Huh. Well, okay. A couple possibilities present themselves: a bloody coup, or waiting several decades until influential ideologues retire. The daunting, somewhat depressing reality is that ideologues, people in positions of power who have staked their career on sex denialism are unlikely to change their stance by being presented with compelling facts and rational arguments. Indeed, sex denialism as a life view depends entirely on ignoring facts.

Three very powerful ideologues drove the IOC’s ever more disastrous male inclusion policy from 2012 to 2025: Thomas Bach, who was first elected IOC president in 2013; Dr. Richard Budgett, Medical and Science Director from 2012 to 2024; and Madeleine Pape, an academic sociologist who co-authored that monument to incoherence, the 2021 Framework for Fairness, Inclusion, and Non-Discrimination. Certainly there were others in that giant organization that supported male inclusion in the female category to varying degrees, as well as those who had questions or outright opposed it, but as anyone who has worked in institutions knows, an idea this comprehensively wrong can only exist through ruthless means: Go along with it completely or you’re out. In this way, even a very few fervent believers in key positions can poison an entire organization.

Kirsty Coventry joined the IOC in 2013, the same year Thomas Bach was elected president. She was there for all the public disasters their male inclusion policy wrought—the completely male podium in the women’s 800-meter race in 2016, “Laurel” Hubbard in 2021, and the coup de gras, male boxer Imane Khelif getting a gold medal for punching women—as well as the ever more absurd eligibility policies of 2015—males can keep their gonads but have to reduce their testosterone to the lower end of the healthy male range to compete in women’s sports, and 2021—males don’t have to do anything to compete in women’s sports because they have “no presumption of advantage.” Coventry’s feelings about the organization’s descent into crazyville are not known. That she still had her job in 2025 is evidence she had the political acumen to, as Jon Pike said, “keep her mouth shut and sit on her hands until she could affect a change. Kirsty is very loyal to the Olympic movement, very much a team player. Staying with your pals and choosing your moment to speak out—these are political judgments.”

There was certainly no coup. Bach was not forced out; he enjoyed the full allowable extent of his presidency—an eight-year-term followed by another four-year term. Budgett retired in 2024, having served as Medical and Science Director for 12 years. He also had served his full term and retired of his own volition. Madeleine Pape, having done all the damage she could in five years or so, also left of her own free will, having seen the writing on the wall when Coventry was elected on a protect-the-women’s-category platform.

“Getting rid of Bach was crucial. He was a block to change, and there was no convincing Madeleine Pape [of returning to female-only category]. She is an archetypical postmodern science denier. Sex is a social construct, the whole thing. She had some heft at the IOC because she had raced against and lost to Semenya in 2009, initially thought it was unfair, then had a career-ending injury, and educated herself about DSDs by reading Anne Fausto-Sterling.”

Here’s a brief but illustrative Madeleine Pape detour. Her extremely influential brand of genderism could be listed right up there with David Koresh and Jim Jones, but for reasons of space, I will restrict my assessment of her “philosophy” to this quote from the gushing linked profile article above:

“What was ultimately more important for me was to let go of the scientific dimension of this issue and to really think carefully about what the regulation of gender eligibility actually means in practice, for the women who are affected.”

The “women” who are affected were, of course, men. Remember that Pape’s towering achievement at the IOC was co-authoring (with the Director of Human Rights) the 2021 Framework featuring the novel notion that if any man was in the female category, it should be presumed he had no male advantage. Because he said so. This is what happens when a sports organization lets go of the scientific dimension of sport.

I digress.

Getting new leadership was a necessary step to returning to sanity for the IOC, BUT such a drastic and time-consuming step may not be necessary for other sports organizations. Jon Pike explained: “The IOC is not the same as other institutions. They are unique. They’re at the top of the tree, they’re accountable to no one. Other institutions might change because they see what the IOC have done and want to be in line with that, so they [other organizations] could make that change without sweeping out existing administrations.”

Pike pointed to the FAQs that the IOC subsequently published, including prepubertal sex differences, that make the IOC policy generalizable to recreational and grassroots sports. “This information will trickle down to International and National Federations and Olympic development programs. Youth programs will have to follow Olympic rules. Your local running club can still support unfair sport for women, but it will be recognized as unfair because the IOC has done that work, made the decision, and backed it up with robust science.”

There is a complementary action to Step One, above, that, in the case of the IOC, facilitated Getting New Leadership. I’ll call this…

Step 1a: Natural Consequences

A natural consequence of allowing men in women’s sports is that men will be in women’s sports. On TV. In the Olympics. With millions of people watching. It’s relatively easy to control the IOC committee members; much harder to control the views of the public. Millions of people saw three male runners with DSDs sweep the women’s 800-meter podium in 2016. Millions of people saw 43-year-old Gavin “Laurel” Hubbard compete in women’s weightlifting in 2021. Millions of people saw two boxers who had previously failed sex verification screens receive gold medals for punching women in 2024. In the NCAA, an organization that had used the IOC’s inclusion policy as a model, experienced the natural consequence of that policy when Will “Lia” Thomas was given a women’s National Championship in swimming in 2022. Attempts to shame, threaten, and silence female athletes (NCAA), and embarrassingly absurd press conferences (IOC) only added to the injustice that millions of people witnessed.

Fiona McAnena described the moment when the previous administration reached peak natural consequences: “In one memorable [press] conference, Thomas Bach, the IOC’s president, claimed that determining who was male or female was beyond the IOC, and that any scientist who could assist with this perplexing challenge would be welcome.”

“The IOC survived Semenya, but could not have survived Khelif,” Pike said. “Two things were particularly condemnatory of the IOC: the daily press conferences in Paris and the 2021 Framework document. Those were so powerful. They both said, ‘This organization isn’t professional. It’s floundering.’ It was apparent within the IOC that a change of leadership was necessary after Paris. The daily press conferences defending male boxers, saying they had to rely on ‘passport sex’—it was an obvious scandal, an embarrassment. Coventry was well positioned to clean up the mess.”

Again, it’s possible organizations lower on the totem pole may be able to use the IOC’s grim experiences to bypass both Getting New Leadership and suffering such bruising Natural Consequences.

Step Two: Information Belongs To The People, Public Debate is Key

The decision to include males in female sport has always been done secretively, with no transparency about who was consulted and what information was prioritized to arrive at those policies. The first time most people realized the IOC had breached a sex category was more than a decade after the policy had been made. Democratizing information can help liberate an institution from ideological capture, by shifting public opinion.

As Fiona McAnena pointed out that while legal victories for “trans” people in the 2010’s led the IOC to loosen requirements for men who wished to compete in women’s sports, by the time “Laurel” Hubbard revealed what inclusion really meant, public opinion had shifted to be much less supportive of the idea.

Much of the science, the actual legwork, underpinning protection of the women’s category was done very publicly by World Athletics, leading to their 2023 restoration of the women’s category. World Athletics (along with World Aquatics, which ring-fenced the women’s category in 2022) is one of the largest and most influential members of the IOC. “World Athletics played a key role [in the IOC’s decision],” Pike said. “Athletics has confronted male advantage, and particularly XY 5-ARD, for two decades. They made some false moves, but worked it through. All those experiences were reflected in Seb Coe’s [IOC presidential] candidacy. That World Athletics had already done the work, and their policy was favorably received by athletes and the public—that was extremely influential.”

“Around 2020, there was a real change,” Pike said. “Emma Hilton and Tommy Lundberg published their study in 2021. Ross Tucker, Cathy Devine, Miraslov Imbrisevic, Greg Brown, and others—our papers are open access. They’re out there and you can read them. And on social media. We won Twitter. Anyone could read our arguments, and they were clear and compelling, based on evidence, science, and rationality. People could read our arguments and compare them with what trans rights activists were saying. They could see that we had patiently plugged away, that it was about fair competition rather than hostility toward trans people as activists were imputing. It made a big difference.”

Ross Tucker related a similar experience with policymaking via side-by-side comparison of the arguments. When World Rugby reviewed their eligibility policy for the female category in 2020, each side, those for male inclusion and those opposed, were given time to present their arguments to the committee. By the morning coffee break on the first day, those who had been undecided remarked on the startling difference in quality of argument—those for a female-only category were evidence-based, rational, scientific while those for male inclusion relied entirely on emotion and stating repeatedly that they were right. The result? World Rugby was the first international sports body to break with Olympic “inclusion” policy and restricted women’s rugby to female-only in 2020.

Step Three: Be Right. If in question, stick with Reality

Being right is a powerful way—probably THE most powerful way—to liberate a captured organization. As Sall Grover, an Australian businesswoman who has been forced into women’s rights advocacy, said of her more-than-four-year legal battle for a women’s-only social media app, “I know we are right and I know that reality always wins - eventually. Reality is inescapable.”

Echoing that idea, Pike said, “In the end, the IOC was confronted with reality. Even as the truth will out, maintaining a lie is unsustainable. It takes too much effort to continually repeat slogans, silence female athletes voices and try to shut down compelling arguments that are out on social media for anyone to see. In the end, good work, good arguments will out. Because it’s not just another viewpoint—it’s right. Ethics are on our side.”

Because of that incident, the nine-year-old I know is cooled on running the race this year. Not fun. Because that event recognized and awarded a kid who cheated. They didn’t care about cheating, which, though my young athlete couldn’t articulate it, showed the race organizers didn’t respect the kids or the event enough to ensure fairness.

Kids understand intimately that ANY sporting event, ANY competition, even a fun run, has to adhere to rules, to basic standards of fairness, or else it’s not fun. How many times have you heard adults, particularly those advocating for boys who identify as girls to be able to be able to participate in the girls category, say that kids’ sports are just about participation? An obvious obfuscation, since virtually every kid ever born can participate in the fun run, t-ball, 8U soccer. What those adults mean by “participation” is that, kids’ sports are not important, adherence to the rules is not important, fairness is not important, but what is important is that some kids be able to do whatever they want to. Some kids should be able to choose what category they want to participate in. “Participation” means no rules. Do whatever you want. Run three-quarters of the race while everyone else runs the whole thing. And take the award. They have replaced kids’ sports with a free-for-all affirmation exercise. Which is inherently disrespectful of children.

Children—eight, nine years old—they know this is bogus bullshit. It’s not a game or a sporting event. It’s certainly not fun. And they will decline to participate.

As a post script, since most nine-year-olds in public school are already indoctrinated into gender ideology—the kid they knew as Charles, a boy, they must now call Charlie, because he’s actually a girl—it’s doubtful they would see boys participating in girls’ sports as cheating. This ABC News article is remarkable because it calls out two men (and the article calls them men) as cheaters for running and winning awards in the women’s category of the Two Oceans Marathon. As if this has not been happening for more than a decade, when they’ve been calling it “inclusion.”

ABC News clearly stating the sex of the men, and identifying it as cheating, tells you this was not about “trans women.” In fact, two men used the bib numbers of two women they knew who had entered the race but were unable to run it. The men did not identify as women, but rather just used a female friend’s bib and didn’t think through that they were registered in the women’s category.

Here’s the important part: Using this incident and the recent restriction of the women’s category to females only by the IOC, Two Oceans Marathon officials have, to their great credit, also restricted their women’s category to females only. They will not be verifying every one of the 16,000 entries with a cheek swab—for everyone who enters in the open (not elite) category, it’s still honor system, as it’s always been. Since the race officials have clearly stated their policy of sex-separated male and female categories, they expect runners to sign up in their correct sex category. BUT since they have stated that policy, if a man, for whatever reason—using a woman’s bib or self-IDing as a woman—was identified by whatever means, and particularly if that man won an award in the women’s category, he would face disqualification and banning from the event for two years. There will be no genital checks, for the love of god. Race officials have simply respected fairness for all runners by having a policy of sex-separated (and within sex, age) categories. They expect runners to show the same respect by following those rules. As simple, straightforward and fair as that is, Two Oceans Marathon is very much in the minority with that policy.

The NYC Marathon, for example, has an “inclusive” transgender policy, based on self-ID for all open (non-elite) entrants. They offer a nonbinary category but clearly state that “transgender” runners may enter according to their identity. By having this policy, NYC Marathon officials are prioritizing the desire of men to affirm their feminine identity over fairness for the approximately 25,000 female runners. To them, affirming a few men’s false beliefs about themselves is more important than respecting ALL women’s right to an all-female category. NYC Marathon officials know it is unfair for men to compete in the women’s category but they have turned a sports event, an athletic competition, into an affirmation exercise.

Two Oceans Marathon respected the reality of sex and fairness that is at the very foundation of sports, and defended the sex boundary around the female category. The two men admitted their mistake, and accepted the punishment, while the two women they displaced from the top 10 were awarded their correct position. (Of course, all the thousands of women after 10th place also moved up two places).

If men—just men, for whatever reason—enter the NYC Marathon, or almost any marathon in the U.S., in the women’s category and happen to place in the top 10, they will be given a women’s award and a woman’s place. Instead of calling out men as cheaters, the media will hail the “inclusivity” of the NYC Marathon, and the bravery of “trans women.”

Men competing in the women’s category—is it cheating or is it inclusion? Would ABC News have used that headline—men cheating in the women’s category—if those men had claimed feminine identities and run in the NYC Marathon?

Call me obsessed—I prefer to think of it as “sane” or “curious about how exactly the entire world lost its collective mind”—but since most women are still affected by the Afghanistan produced by the IOC’s 23-year bout of slavering male mania, such that major media framed that organization’s deliverance from evil to the sunlight of women’s sports for women as “restricting trans rights,” it seems reasonable to treat this as an ongoing epidemic. To understand it and prevent future outbreaks, you have to go back to the first public record of the disease as policy in sport, the IOC’s 2003 Stockholm Consensus.

Dangerously well-informed Canadian Olympian and women’s sports advocate (I guess dangerous and well-informed are redundant) Alison Sydor, knowing I’m vulnerable to suggestion, sent me three links: Emma Hilton’s 2019 talk in which she describes the remarkable lack of science behind the IOC’s policies 2003 through 2021; the Stockholm Consensus link, above, that includes all the authors of that document; and a 2005 Lancet article written by Arne Ljungqvist and Myron Genel, two of the 2003 IOC Medical Committee members, detailing how they came to the (science-free) decision to allow “male transsexuals” into female sports. If you’ve got a lot of time, I encourage you to read/listen to them all. Anyway, the ensuing traumatic event is essentially all Alison’s fault.

All seven people on the 2003 IOC Medical Committee are really old, possibly dead. As such, it’s important to talk to the living. You know, primary source journalism. I emailed Ljungqvist, Joe Simpson and Myron Genel, asking them to talk about their 2003 decision to allow men in women’s sports, in light of the IOC’s recent return to sex-based categories. Myron Genel got back to me the same day, and we made a date to talk on the phone the following day.

As you would, I panicked and really prepared for this interview with an expert, an architect of the IOC’s very first male-in-female-sports policy. I read virtually everything—the Lancet article, listened to Emma Hilton, Myron’s many publications, as recent as 2023, on the inclusion of “transgender” athletes in women’s sports, and familiarized myself with his long resume—professor emeritus and senior research scientist and clinician in pediatrics at the Yale School of Medicine, expert advisor for the IAAF (now World Athletics) in the 1990s, one of seven people on the medical committee making policy for the IOC in 2003 and 2015, member of the Court of Arbitration for Sport, author of 197 papers on pediatric endocrinology. That isn’t even the half of it. I frantically emailed Alison Sydor and asked her what she would ask this legend of sport policy. I made up an optimistic list of 23 questions based on my research. Alison sent me a list of questions. I was very concerned about looking stupid while talking to this person whose entire career was navigating the complex world of pediatric DSDs. Myron is, on paper, outrageously credentialed, absolutely in the thick of sports policy around sex and gender since the 1990s.

Prior to our phone call,Myron emailed me this 2025 paper arguing against SRY screening in the female category. Seems like he hadn’t changed his mind about men in women’s sports. I replied for the sake of discussion, with two short videos by Ross Tucker supporting SRY screening and explaining the CAIS exemption. (Which he ignored). The more I read, the greater the dissonance between Myron’s “research” and his reputation as a “scientific and medical expert” became. For example, the very first sentence of his 2017 article in Current Sports Medicine Reports entitled Transgender Athletes: How Can They Be Accommodated?:

From ancient times, competitive sport has been divided primarily by the traditional concepts of male/female identity…

Uhhmmm, male and female have, since ancient times, been identity categories? Not sex? Calling sex categories “traditional,” as if the ancient Greeks had arbitrarily made them up and they sort of stuck?

Myron was also, as I discovered within the first 20 seconds of our conversation, 1) nearly totally deaf, 2) suffering from probably age-related confusion, and 3) utterly unfamiliar with being asked questions or challenged when he espoused absolute falsehoods. To say our conversation did not go well is an understatement of Olympic proportion. I regret that I’m not tech savvy enough to have recorded the incident so you could fully appreciate the wild swoops and sudden veerings of our chat. It was a pretty busy 10 minutes for me, trying to take notes with one hand, shouting into my phone which I held right close to my mouth with the other, and hanging on with both hands to Myron’s driverless train of thought.

Here’s the conversation according to my notes. Just envision all of my lines delivered at glass-shattering volume.

Me: As I mentioned in my email, I’m interested in the discussion that led to the 2003 Stockholm Consensus. It sounds from your 2005 Lancet article like the IOC was not concerned about male advantage from DSDs. Why is that?

Myron: It was not clear at the time but that changed. Further research indicated postpubertal transgender athletes did not fully adjust from male to female as we thought. That was an important caveat. It was later demonstrated that there was residual muscle power remaining after the two year limit. The main caveat, the most important adjustment made by the IOC was the recommendation that participation by transgender athletes should be, well, there were two… 1. They should be adjusted on a sport-by-sport basis. It would be ridiculous to say there was any advantage in, say, archery or horse riding. That’s absurd. So it needed to be sport specific. In those sports that were…where muscle power is, uhhh…track and field and swimming were the most prominent. That’s different. The other issue is that transgender was often conflated with DSDs. Caster Semenya and others. She identified as female. Born and raised as females…DSD conflated with…. these women….conflated with… uhhhhh, so that was…

Me: I think the reason some male DSDs—5-ARD, what Caster Semenya had—and male transsexuals, as you called them in 2003, are conflated is that they both have male advantage. Isn’t that what you were concerned with? Male advantage in female sports?

Myron: Well… yeah…alright… from my perspective, our conclusion was…the fundamental recommendations were, they were born and raised as females so they should compete in the female category. And…

Me: Why? How is that fair for females? 5-ARD is a male DSD. It only affects males. Yes, Semenya was recorded as female at birth but that was a mistake by the attending physician at his birth. The IAAF knew Caster Semenya was male back in 2009. Why should women have to pay for a mistake made by the attending physician at birth?

Myron: Well… yeah…[laughs]… Again, I repeat, I think it is… decisions on this should be sports specific.

Me: Well, to your point, I think horse riding is not separated by sex, and archery—men have longer arms and much more upper body strength than women. Like 30% more. So they can draw the bow more easily. So archery is sex affected.

Myron: Look, does a 6’10” woman have an unfair advantage in volleyball?

Me: We don’t have volleyball teams for tall women and short women. We have women’s volleyball and men’s volleyball. There are a lot of tall women in volleyball but it’s not unfair to be a 6’10” woman because they’re all women. Or they’re supposed to be.

Myron: [mumbling] Did you call…look, what we said was…it should be sport-by-sport…

Me: Yes, but Caster Semenya did run in a sport affected by power, endurance, and strength. He did have male advantage. He is male. Why is it fair for him to race in the female category just because of a mistake made at his birth? That happens with a lot of 5-ARD babies born in less developed places.

Myron: [mumbled] Well, she was born and raised female…

Me: That’s not true. Semenya was born male, 100% male but with a genetic problem in that he didn’t develop a penis. Otherwise completely male. Went through male puberty [crippling dissonance as I’m explaining XY 5-ARD to a pediatric endocrinologist who treated 5-ARD patients for more than 50 years]

Myron: I’m not saying she… it’s not necessarily fair for her to compete in the 800 …

Me: But he did compete and won a gold medal and….

Myron: [yelling] Look, did you call to argue with me? I have better things to do.

[I realized the conversation had devolved and was circling the bowl, so I cut bait, and went directly to the ten-million-dollar question, which, ironically, Alison and I had independently starred on both of our question lists as the key, the bottom line, if I got nothing else. This one question answers everything about why men were and are in women’s sports]

Me: I want to talk about something else. Back in 2003, actually before 2003, a handful of male transsexuals—again, that’s the term you used then—had asked the IOC to compete in women’s sports. Of course, there were male and female categories. You knew these men were male, that humans don’t change sex, so these were a few men who had cut off their genitals and thought they were women, identified as women, but of course, they’re still male. Did you ever consider just telling these two transgender athletes no?

Myron: [long silence]

Me: I mean, you called them male transsexuals, so you knew they were male. Not eligible for the female category, right? Did you ever consider just telling them that? And that they could compete in the male category? Was that discussed?

Myron: Ok… alright… [laughs]… Uhhh…..We’re talking about transgender [he exaggerated the enunciation of transgender] athletes, not males or females….These are…people who have changed their gender….

Me: Wait, so are you saying transgender athletes are neither male nor female, that they’re another category of human?

Myron: [distressed, getting louder] Look, I don’t want to argue. Let’s forget about it… DSDs… post-pubertal, who changed their sex, those were people that I used to treat! DSDs born and raised as the gender they… more importantly, if the individual identifies as female at birth…is DSD at birth…

Me: But is it fair for women to have to pay in fairness for a mistake someone made at birth?

Myron: Nevermind what it wasn’t… sport specific…

Me: If you have women’s sports which are designed to include females and exclude males, why would you let in some males?

Myron: [mumbles] Let’s talk about Maria Patino.

Me: Was she the woman, the track athlete, who had XY chromosomes but was androgen insensitive?

Myron: [yelling] Alright, look, I don’t have time for this. I didn’t think you were calling…

Me: I just want to clarify—she was XY but had CAIS, right? The new IOC policy has a special exemption for CAIS. They will be flagged by the SRY screen but that’s the thing—it’s just a screen. They aren’t excluded on that. And all women who wish to compete in the female category will have this SRY screen, so no one will be targeted or singled out. And if further testing shows they have CAIS, they are cleared to compete in the female category. No male advantage. Maria Patino would be eligible to compete.

Myron: Oh. So we agree on that.

Me: In the 2005 Lancet article you wrote with Arne Ljungqvist, you mentioned that males who had gonadectomies and took hormones similar to a female profile would probably be few in number, and that they’d be mostly in Masters age level, but then you mentioned Renee Richards and a couple transsexual golfers who had been quite successful at the top level of women’s sports. But you then went on to say it would be fair and recommended the IOC adopt that policy. Why? Why not do more research?

Myron: [long silence] Alright…Ok [laughs]… I’m not… the article…I told you I didn’t… [shouting] that was 1999! I don’t want to talk about an article from 1999!

Me: But you made a policy that was really revolutionary. Allowing a way for men to compete in the female category. I want to know what you were thinking when you made that policy.

Myron: [shouting] I’M NOT TALKING ABOUT THAT! You’ve called to argue. I thought you were calling to talk about…You’re just calling to argue…there’s nothing to discuss. Thank you. Goodbye. I have more important things to do. [hangs up]

I’m pretty cynical about the process of policymaking that broke the sex boundary, that first allowed men in women’s sports—the quality of science and medicine and ethics, and the responsibility to balance and include all stakeholders in the process— but this shocked me. It’s clear, Myron was not chosen to be one of those seven experts on the Science and Medicine Committee, or subsequent consultations, because of his expertise and specialized knowledge. There were many others with at least as much knowledge and experience. He was chosen for his commitment to advancing gender ideology and willingness to overlook science and ethics when it was inconvenient.

There was something profoundly disturbing about a medical professional of his stature mouthing absolute nonsensical, easily proven, falsehoods—that Caster Semenya was born female, that people who believe they are the opposite sex are neither male nor female (but should compete as females). Did he really believe these absurdities, or is this just what he tells journalists? Either way, shocking. And if possible, even more disturbing was that he didn’t seem to have any concern for the global destruction of women’s rights that resulted from his lies.

Myron never mentioned women in our conversation, and it’s clear that the 2003 Stockholm Committee never considered women, half the population, as “having rights.” I sort of knew that, in my gut—that’s the only way they could have come to the decision they did—but for Myron to flat out admit it, and angrily defend it, was shocking. I keep using that word; I can’t think of something stronger. Their focus was, always and singularly, on the desires of men. No matter how few (when the WIAA allowed boys to self-ID into girls’ sports in 2007, there were zero boys seeking to do so; the NCAA erased women’s sports in 2010 for perhaps two male athletes), no matter that these men were clinically mentally unwell, Myron et al never even considered simply telling these men no. Wouldn’t that be the normal response to two objectively unhinged men making insane requests of the largest, most elite sports organization in the world? Just a simple, No? I am haunted by the monumental waste of time and resources, the 23-year injustice to women, that could have been avoided had those seven people simply made the obvious decision to gently blow off two deluded men. That they didn’t, that instead they honored those unwell men’s demands, fully aware that this would harm all women, is really hard to comprehend. It’s a gut punch to hear an “expert,” a person with power and influence, say that women don’t really matter. They’re sub-human. And that men do. Always. It’s shocking to know without a shadow of doubt that the IOC’s decision in 2003 was not based on science, or medicine, or ethics, or even legality, but because men wanted it. I like to think that in 2026 we’ve progressed, that we’re enlightened, living in an age of reason, that women are of course the equal but distinct other class of human, that we’re better than Afghanistan. And then I talked to Myron for 10 minutes, and a pretty ugly truth emerged. Myron’s pissed off that I asked those questions, and I’m kind of sickened by the result. Lose-lose. That’s gender ideology/unadulterated patriarchy in a nutshell.

That’s some existential shit. Okay. Deep breath. What’s even more astounding, in a good way, than 23 years of wandering through smoking, post-apocalyptic, craven-masses-huddled-in-caves man-iverse? That in about nine months (coincidence?), Kirsty Coventry, Dr. Jane Thornton, a working group of people who pay attention to science, and female athletes (!) have miraculously delivered the IOC, at least, out of darkness into the sunshine of women as a recognizable and recognized group. That’s my next post. Take this news with alcohol, and carry on.

It was certainly good news to hear IOC President Kirsty Coventry announce that that organization has defined the female category for females only at the elite level, and will use SRY screening to defend that category. I don’t want to take anything away from the hallelujah moment, for women, for the IOC, for sport, for science. And I’m not. This announcement should be celebrated as a triumph of truth and reality and rightness on every level. This is what I’ve been yipping about for more than a decade and now it’s here—yes, for the love of god, women’s sports for women! Amen!

But that announcement is incomplete. I am not the only one who feels neither satisfied, nor sane, in 2026, hurrahing for women’s sports for women. Really? The big news in 2026 is that men will no longer be allowed in women’s sports? Women’s sports for women—was that not the IOC’s stance for 80 years or so up until 2003? Are we supposed to not know that? Or be so overjoyed and grateful at being recognized as the other sex class of humans that we can pretend the last 23 years or so did not happen?

We have to talk about that nearly quarter century during which the IOC, the largest and most influential sports organization in the world, made a way for men to compete in women’s sports, a category specifically designed to exclude them. We need a reckoning, an admission of harm done. Without it, this crime/injustice/violation—none of those words are adequate for what is still happening in women’s sports—will happen again.

In her announcement, Kirsty Coventry said the decision to protect the female category is “foundationally based on science, and led by medical experts, with the best interests of athletes right at the heart.” Here’s the thing: There was no new science. All of the science on sex differences in sport existed 23 years ago. Men were not women in 2003. It was not fair for men to compete in women’s sports in 2003, and the IOC knew it. In fact, the only scientific evidence the IOC had in 2003 was that allowing “male transsexuals” into women’s sports would be “unfair, potentially dangerous in some sports, and would undermine women’s sports.” That’s a quote from Dr. Richard Budgett, who would become the medical director of the IOC, and personally preside over the very first inclusion of men in women’s competition. All of the science, medical expertise, and female athletes’ voices that Coventry said informed their decision to limit women’s sports to females were present in 2003 when they first obliterated the female category. They simply ignored this information and prioritized the desires of a handful of men who demanded to compete in the women’s category.

They sold this as “inclusion,” a human right for some men to be included in a category designed to exclude them. Think about that insanity. The utter disconnection from reality, the sudden veering into flat earth territory by the largest, most influential sports organization in the world. And for the next 23 years, they continued to make it easier for men to compete in women’s sports, and continued to lie to women and the public about the unfairness, and even the fact that “trans women” were really men, as the science, medical experts, female athletes’ voices, and reality itself continued to reveal the wrongness of their insane policy.

It’s important to understand the enormity of that betrayal of women and their own charter as a sports organization. First, this was not your local football club that made a rogue bad policy. It was the freaking IOC. They have a duty to be extra cautious, extra conservative, meticulous about due diligence with even the slightest policy change. The more radical the change, the more transparent the process and rigorous the evidence should be. They did none of that. The most prestigious sports organization in the world went absolutely bonkers, adopting an anti-reality.made-up ideology that claims men are women because they say so.

Second, allowing men in women’s sports is as radical as it gets. It was not a nuanced shift in policy; it was a reckless leap into the void, knowing only that it would harm women. The IOC wiped out one of two sex categories, the most fundamental, uncontroversial fairness measure in sports, something that had never even been posited, much less executed, with regard to any sports category. In the history of sport. “Inclusion” for weight categories? For age, or ability? Absurd, unthinkable. Redefining the eligibility standards for a category such that it includes those it was designed to exclude, introducing unfairness and safety risks—violation, injustice, crime—words fall short of describing the extremity of that action.

The IOC also knew that their policy would trickle down to every sport in every country at every level. They all did it because the IOC did it. The IOC led what is unquestionably the most devastating assault on women’s and girls sports ever launched, and the majority of female athletes are still suffering from their 2003 decision. And women are supposed to forget that?

Sadly, it was not a realization that they were visiting unspeakable harm on women and women’s sports that prompted the IOC’s eventual return to protecting the female category, but rather the untenable damage to their reputation the policy had wrought. From the all-male DSD podium in the 2016 women’s 800-meter race to 43-year-old Gavin (Laurel) Hubbard at the 2021 Olympics to male boxer Imane Khelif being awarded a gold medal for punching women, and then-President Thomas Bach insisting on worldwide TV that Khelif was a woman, the IOC had publicly sacrificed their reputation on the altar of gender ideology.

Regarding my (idealistic? naive?) call for a reckoning and admission of harm done, Olympian and women’s sports advocate Sharron Davies brought me back to planet Earth: “It would open them up to legal challenge for compensation.” Plain truth from a businesswoman and athlete who has spent decades seeking justice for female athletes cheated by the East German doping program of the 1970s and 1980s. Admitting culpability in the global undermining of women’s sports would be financially ruinous to the IOC (see also: Catholic Church). Whether or not they should suffer that consequence is irrelevant: A reckoning won’t happen.

Nonetheless, the IOC seems to realize, if not the harm done to women, then at least the harm done to their reputation, and have gone about this policy change in a markedly different way than they have over the last 23 years. To save their reputation, and possibly, as a fringe benefit, women’s sports.

For one thing, they were transparent about who they consulted in developing this policy—endocrinologists, sport scientists, ethics people, female athletes, legal, human rights (that’s code for trans advocates). This is a change. Transparency has not, to this point, been in the IOC skill set. No one knew who they consulted or how they “developed” the 2003 policy to allow men into women’s sports, but based on the results, it’s certain endocrinologists, sport scientists, and female athletes were not consulted, and trans advocates were. In 2003, transpeak was used in all communications—no biological terms were used, a marked lack of science in any form. Instead, “inclusion,” “human rights,” “sports for all,” “trans women,” “no presumption of advantage,” was the new and confusing language used.

In sharp contrast, at about 14:10 in the 2026 press conference, Jane Thornton, the IOC science and medical director, said the Working Group agreed on a number of definitions: sex as male and female, and unchanging, and gender and gender identity as a changeable sense of self, and that sex differences from birth made it necessary to restrict the female category to females. That to do otherwise is unfair to women. That we all know the definitions they agreed on, and the process by which they came to the decision to recognize the reality of sex is money in the bank. It would be difficult to walk back those publicly made and scientifically based statements. Transparent, understandable, scientific, reflecting a reality we all recognize—what Thornton was communicating without saying it is that this is a sharp 180 from the previous 23 years. What she actually voiced is that, by following science, the IOC realizes sex matters, women’s sports must be female only, and that SRY screening is the best method for ensuring that. But what she implied is that this is a change—the IOC had NOT, for the past 23 years, been following science, and certainly had not listened to female athletes.

That’s as close as we’re going to get to a reckoning. What the IOC did do is present the truth of women’s sex-based rights, publicly, locked and loaded, and user friendly. Let the trickle down begin! And can we please start with the BBC?

About a year ago, what would have been US Masters swimmer Angie Griffin’s first individual National Championship was given to a male, Hugo “Hannah/Ana” Caldas, who has been misrepresenting himself as a woman and stealing women’s opportunities and awards in swimming, rowing, crossfit, and the now-defunct Grid League weightlifting competition over a 16-year period. Griffin, pictured above, didn’t know any of that last April.

During the 2025 National Championship meet several news sources identified Caldas as male. On May 1, Griffin and other Masters swimmers filed a complaint against US Masters Swimming claiming their policy of allowing males to race against females was unfair.

Seven months later, after making public documented evidence of unfairness and calls for reform, Griffin received an email saying a grievance had been filed against her claiming her posts on the USMS Community Forum constituted bullying, harassment, and unsporting conduct. To be clear, USMS is defending a man they enabled to lie and cheat women out of awards for 16 years, has been called out by their own parent organization for lying about that man’s sex, have violated their own policies they know to be unfair to allow a man to compete in women’s events, and have facilitated and promoted public attacks on Griffin’s character. Griffin now faces a USMS tribunal over her conduct—not for lying or cheating—for speaking out for fairness for women, with a potential lifetime ban from Masters swimming. USMS has never threatened such severe punishment before, for any offense.

The tribunal was scheduled to take place via Zoom on April 7, 2026, but on March 28, was postponed. No new date has been set.

So determined is US Masters Swimming to punish Angie Griffin, to protect a lying, cheating man, and to persist with their absurdly misogynistic policies they are willing to risk their status as a US regulatory body to continue with this sham tribunal. USMS has come under scrutiny by the Aquatics Integrity Unit for what is widely acknowledged by the swimming world to be harassment and bullying of Griffin as retribution, as an example to others of what happens when women stand up for their rights.

That’s the stripped down version. The details are much crazier. This shameful campaign of abuse is a slow motion train wreck but it’s necessary to wade into the mess to understand the lengths a national sports organization, whose job it is to make their sport fair, will go to allow men to compete in women’s swimming. And to punish women who object.

I talked with Angie on the phone.

Angie Griffin swam in USA Swimming programs as a kid and in high school, but gave it up as an adult. About ten years ago she was overweight and decided to do something about it, so she got back in the water. Someone at the city pool suggested she try Masters Swimming.

“It opened a whole new world to me,” she said. “Friends and competition and feeling young again.”

Unlike other sports, US Masters Swimming is a separate entity from USA Swimming. World Aquatics is the international organization. USA Swimming has an 18+ program for more serious swimmers, while Masters Swimming is considered the more recreational track. USMS emphasizes participation—just for fun :) — over competition to justify inclusion of males in women’s events, but of course, they treat the ability of men to choose the category in which they participate as a matter of life and death. And they are apparently willing to die on that hill.

“You don’t have to qualify for Nationals, but Masters swimmers take competition very seriously,” Angie said. “Ten years ago, 11 now, when I first went to Nationals there were tons of Olympians there. It was also in San Antonio. Sort of why winning that 50 Breast would have been awesome ten years later at the same pool. It was such a fun experience to be racing against these celebrities. That’s what’s so great about Masters Swimming—everyone’s included, but it shouldn’t be at the expense of women.”

“I did see him [Caldas] at the meet. I didn’t voice my suspicions but nearly everyone, men and women, at the meet wondered aloud if he was using steroids, or what. I just thought he was really big for a girl—not that tall but broad, big shoulders, big biceps, really intimidating. I swam right next to him in two races on Friday—I got second and third. Sunday was redemption—I anchored our winning relay. It was the best feeling ever, winning that National title.

“Monday I got off the plane and my phone was blown up with texts, stories on the internet about Caldas being trans, that he won five National titles just that weekend, and he’d been taking national and world titles and Crossfit prizes for years. My mind was blown.

“People say, oh it’s just Masters, but it would have been my first individual National Championship. I’d get my patch. It meant something to me. I trained for it. It might not seem like a big deal, but I spent time and money getting to Texas. I just love swimming and I love racing. I wake up early— 4am—swim or lift weights, go to work climbing utility poles, go home, make dinner and crash at like 8pm. It’s not just Masters.”

The Protest Letter

Angie and others who had raced against Caldas researched policies and filed a protest with the US Masters Swimming Board, pointing out that they had lost places and titles to a biological male, and comparing the larger swim organization’s policies with USMS—World Aquatics banned males who have gone through male puberty, and USA Swimming (in April 2025) required males to have testosterone levels of 5nmol/liter or less for 36 months. In sharp contrast, Angie revealed in her protest letter what she found out when digging into USMS’s transgender policy.

“What I discovered is that USMS changed its transgender guidelines in December 2024 based on the Rules Committee recommendations that are documented in that Committee’s July 9 and August 11, 2024 minutes. The Committee was to review USA Swimming and WA rules and err on the side of less “strict” rules. (Why?) The minutes reflect that the main concern of the Committee was related to who could file a protest, and absent was any significant discussion of the 2022 WA (then FINA) guidelines that are well documented regarding science, safety and fairness.”

Another way to say “less strict” is “unfair.” USMS policy that was in place during 2025 Nationals says that to be eligible for women’s events, men must undergo “hormonal therapy appropriate for the female gender” for a year to “minimize gender-related advantages.” They specified a maximum testosterone level of 5nmol/liter, which is more than double the average female level. BEYOND THAT, the USMS policy says men who don’t alter their hormones at all can still participate in women’s events but their times will be removed and they cannot receive titles, awards or recognition. Note: USMS understands “trans women” are male, that even after hormone suppression they retain advantages, and that including them will introduce unfairness to women. Thus, their focus, not on making fair policy, but on shutting down protests.

Angie, that troublesome and well-informed protester, continued: “The rules are unclear about the exact information and when exactly in the one year period the test results must be done. And the level of testosterone that would meet the testing requirement is double that of a typical woman. How is this fair by any standard?”

Her protest went on to present evidence that Caldas is a biological male who had gone through male puberty and, awkwardly for USMS, had competed in USMS events in the male category in 2002-2004, and “possesses inherent physiological advantages that cannot be mitigated by hormone therapy alone.”

She requested five things from USMS: 1) Detailed documentation that Caldas met the required guidelines, 2) Transparency regarding testosterone compliance, 3) Re-evaluate all the standings from the National meet for women who swam against Caldas, 4) Change USMS policy to focus on fairness, not just inclusion, and 5) Notify USMS members directly of changes to the transgender policy.

She concluded: “I reiterate that this is not about exclusion, I am a proponent of inclusion. It is about ensuring a level playing field for all competitors. …While USMS was so focused on inclusion with its policy, fairness to women in the sport was clearly overlooked.”

It was a helluva protest—calm, reasoned, evidenced, documented, factual. And a real problem for USMS.

USMS Violated Their Own Unfair Policy

Which is why it took them four months to reply. Angie and company also filed a protest about ANOTHER male swimmer at the 2025 National meet who won nothing. Two weeks later, USMS responded that that man was indeed eligible to compete in the women’s category. Since this man received no awards, according to USMS policy, he could participate in women’s events without submitting documentation of his testosterone levels. Just a not very talented man competing in women’s events to affirm his identity. Completely valid, according to USMS policy.

But they were running into trouble answering Angie’s complaint against Caldas. Maybe because, though they knew Caldas is male, USMS had never collected documentation of his testosterone levels that their own unfair policy required, and he had hoovered up LOTS of recognition. They’d been violating their own policy, and allowing a man with unknown levels of testosterone to compete in women’s events for more than a decade as they awarded him 28 women’s Masters national titles. Oops. This was going to require some pretty spectacular prevarication. That’s what took four months.

On August 22, USMS finally replied to Angie’s protest. They said that Caldas had presented “documentation reflecting her sex assigned at birth and her gender identity, including a birth certificate, passport, and U.S. citizenship documents.” All of these documents were falsified, as became evident a few months later. USMS had no answer for why this “woman” had entered male events using a male name between 2002 and 2004: “The documents the swimmer submitted all demonstrate that she was assigned the female sex at birth and that she identifies as female, although she swam in the male category at USMS events 2002-2004.” There. See? A born female decided at some period in her adulthood to use a male name and swim on a male team in the male category for a few years, and then reverted to a woman’s name and the female category where “she” won 28 USMS National titles. That’s USMS’s story, and they’re sticking by it.

So, as of August 2025, USMS lied to Angie, pretending that Caldas is, not transgender, but born female, as evidenced by changeable pieces of paper, thus absolving them of ever having to collect or document his testosterone reduction. Which they likely did not ever do. Also, as a “born female,” by USMS rules, Caldas would be able to not only participate but be recognized as a Masters national title holder, something he’d accomplished 28 times over 16 years. Just in Masters swimming. To say nothing of awards in rowing, Crossfit, and Grid League weightlifting. All of this, because none of these organizations actually defend the female category. With a cheek swab. We know how to verify sex just like we know how to verify age or weight. Organizations, like USMS, prioritized inclusion of males in the female category over fairness for women, and were willing to debase themselves and the sport, and gaslight women, with absurd lies in order to do so.

“When I saw USMS stand firm that he [Caldas] was female, I was so angry, furious is the strongest word I can find,” Angie said. “I was done with Masters swimming. I was done funding them. I was just going to walk away.”

World Aquatics’ Fairness Revealed USMS’ Unfairness and Lies

Then, in October 2025, World Aquatics banned Caldas for five years for violations of multiple rules including providing false sex certification, failing to meet women’s category eligibility criteria, and failing to take a sex verification (cheek swab) screen. Recall that World Athletics offers a female sex category for females only; they do not accept bogus falsified documents as sex verification. WA had been alerted to Caldas’ sex by the same news reports that emerged after the 2025 USMS National meet, noting that Caldas had won two women’s World titles at the 2024 World Masters Championship, their jurisdiction. Retroactively asking for documentation of his female sex, Caldas must have submitted the same falsified birth certificate and passport he’d passed off to USMS. WA wasn’t buying it, Caldas refused to take a sex verification test, and WA banned him for five years from World Aquatics events.

This put USMS in a very awkward position. USMS risked losing association with WA, and national regulatory status, if they did not also ban Caldas from their own events, but of course upholding the ban would confirm that Caldas was male and reveal that USMS was lying to members about Caldas’ sex, and had allowed this male to participate and take women’s awards without ever documenting any testosterone reduction as their policy required. Got it? Oh what tangled webs we weave when we seek to deceive.

As it turns out, Angie was in no way the first or the only person to correctly call Caldas a man and highlight USMS’s years-long culpability in violating women’s right to fair sports. Jonathan Kay published a scathing, in-depth expose for Quillette on October 31, 2025. Kay traced Caldas’ move from participation on a gay men’s swim team to a multi-sport swath of grifting, misrepresenting himself as a woman and cheating women out of scores of national and world titles, all aided by organizations that simply accepted his lie. In fact, “Hannah” Caldas was on the USMS Sports & Medicine Committee in 2012. Employed and originally swimming under the name Hugo Caldas, Kay reported he first changed his name to Hannah, and later to Ana, which disturbingly, is the name of his sister.

The Grievance

On November 1, Angie posted a link to the Quillette article on the USMS Community Forum under a thread titled Trans girls/biological males competing against females:

This Community Forum thread was started around the date of the 2025 USMS National Championship by another USMS member who saw obvious unfairness in USMS’s policy. Many of the commenters agreed with this position, some in much less measured manner than Angie did, but her comments were singled out.

On November 21, Angie received an email from USMS apprising her that a USMS member had filed a grievance against her, claiming her posts on the Community Forum violated USMS’s Code of Ethics, including failure to treat fellow members with respect and dignity, and displaying unsporting conduct. The grievance referenced only two of Angie’s posts as evidence of ethics violations—the one that included the link to the Quillette article, above, and this one:

With only these two posts as evidence, USMS declared that the grievance “had merit” and should proceed to a tribunal. Following are some of Angie’s other comments posted between early May and early November. This is the evidence of bullying, harassment, and unsporting conduct that USMS found serious enough to drag her before a tribunal, and threaten her with a lifetime ban from Masters Swimming. Though out of context, they are remarkably innocuous. Perhaps recognizing that anyone could see that these public posts did not constitute bullying, harassment, and unsporting conduct, the Community Forum moderator went about deleting them. Luckily, Angie took screenshots.

Speaking Out For Fairness Is Deemed Unethical and Unsporting

“I felt so small. Like David and Goliath.” Angie called Kim Jones, the co-founder of ICONS for help.

“Talking about changing policy and asking for fairness is not hateful. I don’t want to hurt anyone by this; I want women to not be hurt. I never targeted the individual. I was sharing publicly available information that could help direct policy in a fair direction.

“If the National Board of Review rules against me, I could be banned from the sport for life. This has never happened before, that’s how severe they think my violation is.

“If the tribunal comes down in my favor nothing really changes. Maybe they retract his [Caldas’] times. The stress it’s caused for the last six months will go away. This has nothing to do with USMS policy or what happened at Nationals—it’s about me being a bully and disrespectful to another swimmer. Even if I ‘win,’ they’ll still think I’m a horrible person.

“I asked Bill Bock (ICONS legal counsel), ‘Should I just quit?’ He said: ‘You have to go through with the tribunal because the accusation is a black mark against you, against your character.’ And that’s the thing—I don’t have bad sportsmanship. I cheer for all the girls in my age group. They’re saying disagreeing is violence and bullying. It’s not.”

The National Board of Review ignored several of Angie’s objections during the process, reiterating that her conduct was on trial, not USMS policy or fairness for women.

At the now-postponed hearing, Angie and the grievant will have 30 minutes each to state their cases. The bitter irony of this insane kangaroo court is the number of egregious ethics and human rights violations that are NOT being reviewed: A man has lied, cheated, and presented falsified documents to steal more than 30 women’s national and world titles in four different sports for 16 years; a national sports organization knowingly violated women’s right to fair sport, failed to follow the procedures of their own unfair policy, and lied to members about a man’s sex; disagreement has been criminalized by calling it misconduct; and that national sports organization has facilitated a campaign of abuse against the woman who pointed out these violations and failures.

Instead, the National Board of Review will judge the behavior of the woman who lost a National Championship to a man, and said something about it.

I’m deep into another story but made the mistake of reading this assault on sanity and crime against journalism by, of all places, AP News. It’s so flagrantly, eye-wateringly, offensively, factually incorrect on every single point, I could not let it go. I dashed this off as a comment, but was then required to create an account. Nope. This article is shamefully factually incorrect from top to bottom. Men are excluded from women’s sports because they are male, not due to any belief about themselves they may have, nor because of Trump. Trump did not invent two sexes last year, for the love of god. Men who believe they are women are male, thus not eligible for the female category. Athletes with transgender identities DID participate in the 2024 Olympics—US track star Nikki Hiltz identifies as masculine nonbinary and boxer Hergie Bacyadan identifies as a man. There was no controversy because both are female and both competed in the female category. Algerian boxer Imane Khelif is male. He won a gold medal in women’s boxing because the IOC accepted a piece of paper that said he was female. He has since admitted being male with the same DSD that Caster Semenya has. He and Semenya are 100% male but suffer from a genetic anomaly such that their external genitalia did not develop, so at birth they were wrongly assigned female. They are completely male without a penis. This DSD only affects males. For AP to report that Semenya is female with naturally high testosterone is completely false in every way. Semenya is and always has been 100% male who did not develop a penis. His testosterone is not high, it is normal for a male. This is beyond sloppy “journalism,” it is propaganda. One has to wonder why AP would print this easily refuted and frankly embarrassing assault on sanity.

Like a majority of Democratic voters, I feel dismayed and betrayed by the fact that Democratic lawmakers have sharply broken with voters, with factual reality, and with common sense.

I’m responding to your letter with verifiable facts. They are not views or opinions, in the same way that sex is an unchanging verifiable fact and gender identity is an unverifiable belief with no basis in reality.

You dismissed Ruen’s questions because they characterized transgender athletes as males. As you know, humans don’t change sex, nor are they born in the wrong body. All humans have rights based on reality; women’s rights are entirely dependent on the reality of their sex. Obviously, if any man can simply declare himself a woman, then the word woman becomes meaningless and women’s rights disappear. People may believe that they are the opposite sex, or both sexes or neither. Like any unverifiable belief (eg, I am a 2:10 marathoner), these are not worthy of special rights, especially when those unverifiable claims infringe on the rights of an objectively real group—women. Male and female are biological terms referring to people whose bodies developed along a pathway to produce eggs or sperm. There is no third or fourth gamete. It’s important to use accurate language. Males from conception are different from females, chromosomally, hormonally, skeletally, physiologically. These differences—more lean muscle mass, longer denser bones, larger heart and lungs, greater blood volume, greater ability to carry oxygen to name a few—cannot be changed and become greater with puberty. You can’t uncook an egg. Men are not women, regardless of belief, declaration, hormonal tinkering or surgery. This fact, one of the few foundational truths of humanity, is the basis of women’s rights, one of which is single-sex sports. And you have no idea how tiresome and frustrating and what a monumental waste of time and effort it has been to calmly and clearly state blindingly obvious facts to those (Democrats) who pretend not to understand. The Minnesota legislature and the Minnesota State High School League back in 2015 did not consult science or coaches or women before they made the radical, unprecedented decision to disregard sex categories and allow any male to self-identify into female sports. The only evidence they had at that time was that it would be unfair, dangerous and deleterious to girls’ sports, but they disregarded these facts and instead based this decision (for reference, no one has EVER even considered “inclusion” in any other sports category—weight, age, ability—much less enacting it) on the fact that a few other cowardly, misguided orgs had violated women’s rights before. And gotten away with it because they called it something nice—inclusion.

Because they all, like you, ASSUMED that someone else had done the research and looked at the science and determined it was fair. They had not. None of them. Two autogynephilic men in 2003 who claimed to be women demanded that the IOC let them compete in women’s sports. Since they’d cut off their penises, and were really poor athletes and obviously not mentally well, the IOC thought there would be no harm in letting them compete as women. Of course, they knew they were violating women’s rights but what the hell, it was just women. I wrote about this initial crime here.

The MSHSL, the NCAA, Washington state athletic association, they knew it was wrong to allow men in women’s sports, but because others had done it, they could pretend it was right. It’s called a circle jerk, Amada. Let me know if you need an explanation. There was NEVER any evidence that allowing males in female sports was anything but wrong on every level. This was quietly disregarded because: Men and money. Trans ideology has been imposed top down by fear, coercion, circle jerks, and billionaire funding. As you are demonstrating, it really works.

Minnesota knew it was wrong, and left themselves an out, legally, by writing an exemption for Athletic Teams to have single-sex sports and locker rooms in the Human Rights Act. Please read it. You may be the only Democrat who has. Why doesn’t anyone talk about this? Why do they insist that it’s illegal to have female-only sports in Minnesota when this exemption exists? Why did lawmakers create this exemption but now pretend it does not exist? Does making female-only sports and spaces illegal sound right to you? Does that sound progressive? How do you propose ensuring opportunities, fairness, safety, dignity, and privacy for girls if any boy can self-identify into girls’ sports? (For starters, a boy using the girls’ locker room is, by definition, sexual harassment, in Minnesota, state-facilitated sexual harassment of ALL girls. I wrote about that too)

Your next paragraph speaks to the small number of kids with trans identities participating in sports. Luckily I did not outsource this question to Democratic talking points but rather called up the Williams Institute that is the leading source of data on kids with trans identities and their rates of sports participation. You can read my entire investigation here, but using Williams Institute’s estimate that 3.3% of high school age kids identify as trans and Minnesota’s approximately 302,602 high school students = 9986 trans-identified high school kids in MN. Williams Institute estimates the percent of trans-identified kids who participate in sports at somewhere between 1% and 20%. Using a median estimate of 10%, that’s 998 high school athletes with trans identities. Almost 1000. That’s not insignificant. As a track and cross country coach at a small private school in the Twin Cities, I personally know of more than 10 trans-identified kids on my small teams in my small school. That 1000 trans athlete estimate seems very low. And NCAA president Charlie Baker was doing something that identified as math when he estimated 10 athletes with trans identities in the entire NCAA. Using Williams Institute’s data, I came up with 7,202 trans-identified athletes in the NCAA. Not ten.

But data means diddly squat to the girl who didn’t make it to state because a boy took her place. And is just one boy watching the girls get undressed okay? Even if a boy is a rubbish athlete, last on the team, he’s still a boy. He doesn’t belong on the girls’ team. Girls’ sports is not an affirmation exercise for boys with girl identities.

This argument—it’s so few—is so stupid, and so frequently used. How many boys in the girls’ category is acceptable? Ten? 100? Just to help you think about this, how many heavyweight wrestlers do officials allow in the 120-pound class? There is no category that allows people who do not qualify in that category. The number is zero. You don’t have to be a coach to figure that out. It’s wrong, everyone knows it, but those who said so lost their jobs. Girls were threatened. You know this. If you actually questioned this violation of girls’ human rights, where would you be in the Democratic party?

Some questions for you: Why do we have boys’ and girls’ sports? Why should girls’ give up their human rights as females and their Title IX rights to single-sex sports and spaces to boys? Why are you supporting this law that erases girls’ rights as humans?

It’s taken 11 years for Minnesotans to learn what “inclusion” means—boys in girls’ sports and spaces. Major international sports organizations outside the US (Minnesota is in the dark ages)—the IOC, World Athletics, World Aquatics, International Cycling, World Rugby, World Triathlon, and many others—have realized their horrific error and have moved to mandate the female category for females only. This had nothing to do with Trump, for the love of god. It’s science. It’s fact. It’s recognizing women as a fully human distinct sex class worthy of their own rights. People who know something about sports have decided, women’s sports must be for women only. Why are you ignoring them?

Laws and policy MUST be based on fact. You are staunchly defending bad laws that enshrine an unverifiable belief system that has no basis in reality with “rights” that erase the rights of half the population. (Note: government backed beliefs = theocracy). You are vigorously supporting erasure of your own rights, and mine. Every woman is a Democrat until she comes face to face with a naked man in the locker room.

As a staunch supporter of “trans rights”— you wrote, “the matter is closed”—I wonder what you have to say to the women of Shakopee Women’s Prison who are sharing showers with these fully intact male murderers and rapists (one man raped his own 3-year-old child) who identified as women after their crimes. She never mentioned girls and women at all in her letter. Only people with a personal unverifiable belief that they are the opposite sex, or both sexes or neither, and as such, deserve more rights. California Interscholastic Federation has set the bar very very high for self-humiliation, but I have confidence they can reach even greater heights—or is it depths? I thought CIF couldn’t have embarrassed themselves any more than they did last May when it became apparent that a boy, AB Hernandez, had a very good chance of winning three GIRLS state championships. And those spineless geniuses at CIF thought, ooo, bad optics. Galvanizing every ounce of their considerable cowardice and remarkable institutional idiocy, CIF established a pilot entry process just for the state championship track meet that applied only to the three events in which Hernandez was entered—the long jump, triple jump, and high jump—such that, if the boy made it into the finals, 12 girls, actual females, could advance to the finals and compete for the state championship. So, in those three events, 13 athletes would advance to the finals instead of the rule standard 12—12 girls and a boy. AND if the special boy got a podium spot, the girl whose spot that should have been would “get” to share her podium spot with Hernandez. This feat of institutional stupidity rose well above run-of-the-mill stupidity by simultaneously adding in criminality, destroying all girls’ Title IX right to single-sex sports, making a joke of the very foundation of competition, AND installing a blinking neon arrow over the male competitor that read: THIS BOY IS NOT A GIRL BUT WE’RE TOO COWARDLY TO TELL HIM TO COMPETE IN THE BOYS’ CATEGORY AND THE GIRLS WILL BE GOOD SPORTS ABOUT GIVING UP ALL THEIR RIGHTS.

As it turns out, last May was not a one off as CIF hoped. They’re still cowardly and stupid, and boys are still not girls, and everyone knows it—shit—so already, so early in this year’s track season, they’ve had to perform the same We Are Fucking Idiots dance. On March 7, at the Roosevelt Invitational in Eagleville, CA, the male athlete, AB Hernandez, swept the high jump, triple jump, and long jump. Even though he had the best jump by a long way, the meet directors “let” the top jumping female athlete stand on the first place podium with the boy. Because: see? Girls are not being displaced by this boy, right? And let’s be clear, everyone KNOWS AB Hernandez is male—CIF acknowledges it, the girls know it, the parents know it, AB Hernandez knows it, everyone knows it. So much for affirming that boy’s feminine identity. The truth is a bitch. But AB Hernandez is not. He’s just a boy.

No matter how you slice it, it’s hard to even count the losers in this situation. First and foremost, girls lose. It’s CIF’s job to administer the rules of sport, one of which is to define and defend categories, sex being foremost among them. They failed girls monumentally by actively welcoming boys with special identities into the sport. Thousands of girls over a single track season are displaced by a single boy. It’s not just places and opportunities that girls lose, it’s the message that a boy is entitled, backed by state law, no less, to choose to compete in girls’ sports, but girls cannot choose to have only female competition. Boys are prioritized in girls’ sports. Boys have all the power in girls’ sports. For no reason other than that they claim a feminine identity. Girls lose big time.

And while we’re on the notion of unverifiable identities, if CIF made a special rule just for one boy in girls’ sports, it’s obvious they should honor girls who identify as boys and compete in boys’ sports. The first place “trans boy” should have shared the podium with the first place boy at the state championship, even if this athlete actually placed last. She was the first “trans boy” and should have been recognized just like the first place “trans girl.” Why did the CIF not make a rule about this? Nevermind that this cohort barely exists (it’s not clear if there were ANY females competing in the male category at the state championship or the Roosevelt Invitational). No one seems to give a fuck about females, regardless of their identity claims. So let’s expand the loser list—ALL females lose. Including those with masculine or nonbinary identities.

AB Hernandez loses. The CIF is running into problems with the whole gender identity thing. To a member, they know like they know their names that Hernandez is male. Hell, Hernandez knows he’s male but is riding this train as far as it will take him. Why not? Can you even imagine being a 17-year-old narcissistic, not entirely mentally healthy boy and having this much personal power over the CIF? But the truth is, his “power” identifies as power. In the same way he’s living a lie, the CIF and every other person watching in the stands knows he’s male. CIF confirms he’s “the male winner of the female triple jump.” Dude, that’s a lose. Not enough makeup in the world to hide that.

You have to almost—almost—be in awe of an organization that is willing to debase itself publicly to this degree. CIF has. And appears to have no end to their willingness to expose their idiocy. Not only making special rules to allow special boys to compete in girls sports, violating Title IX, destroying the integrity of girls’ sports, violating every foundational truth of our society—that and more. There is simply no limit to the degree to which CIF will debase their own organization. That they will commit these crimes against girls, publicly, and lie blatantly—they’ve given away every shred of authority or credibility they ever had. Wow, talk about losers.

Sports lose. Cheats are not treated kindly in sports because cheating is counter to the very soul of sports. Sports strive to be as fair as possible, to control for known advantages—age, weight, ability, experience, and yes, sex—so that talent can be celebrated. Do not start with me about Michael Phelps. Don’t embarrass yourself. Phelps competes against males, males of much the same experience and ability. And wins by milliseconds. He is a champion of his category. People who know something of sports know that watching Michael Phelps swim against women is a display of male advantage. We know that. Not interesting or worth celebrating. A debasement of sports. Pretending that male advantage doesn’t exist is just stupid. People reject that. It’s so obviously empirically wrong, it’s an insult to the idea of competition.

CIF is orchestrating and presiding over a humiliating circus of their own making. It’s grotesque, and everyone recognizes it. This is not progress. It’s not sports. It’s a drag show with unwilling audience and participants.
